The paper addresses issues concerning the fundamental right of access to justice for vulnerable persons, particularly children, in the Italian legal system. After analyzing the aspects related to effective access to justice in the domestic and European legal framework, the need to ensure the judicial protection of people in vulnerable situations is emphasized through the attenuation of procedural «formalism», the adoption of special measures and procedural rules for the processing of the process, which must be adapted to the peculiarity of the factor causing the fragility. The effective implementation of children’s access to justice includes the right to participate and be heard in civil proceedings that affect their lives and also requires that their views be considered following their levels of maturity and understanding. Finally, the rules governing the hearing of minors are exami...

This article discusses the right to political participation in international treaties and decisions of protection bodies. The author notes that while the binding nature of these agreements may vary, international law establishes minimum standards that must be respected regarding political participation. In this context, international protection bodies, such as the Inter-American Court of Human Rights, the Human Rights Committee, and the European Court of Human Rights, have established interpretation criteria not only for judicial operators but also for citizens who claim violations of this right. However, it is important to note that international law presents challenges, such as normative uncertainty and the politicization of dispute resolution. Although progress has been made in guaranteeing political participation, it remains insufficient and must continue to be improved.

Understanding the obstacles to exercising access rights in environmental matters in Colombia through the lens of democracy is the main objective guiding the question: How have the rights of access to information, participation, and justice in environmental matters been exercised since the enactment of the 1991 Political Constitution? To address this objective, a qualitative and socio-legal methodology was employed, incorporating hermeneutics and phenomenology, with a focus on the experiences of environmental rights lawyers. In-depth semi-structured interviews were conducted to gather information, allowing for the triangulation of experiences that have shaped the realities of environmental defenders. The rights of access to information and environmental participation were used as guiding categories, intersecting with access to justice to form the platform in which the defenders' experienc...

Chirikyacu, Chunchiwi, and Chirik Sacha, located in the San Martin region (Peru), are indigenous communities affiliated with the National Program of Forest Conservation for Climate Change Mitigation. The three communities approved the implementation of the Conditional Direct Transfer Mechanism (TDC, acronym in Spanish) as a financial tool for primary forest conservation. This research characterizes the participation of the beneficiaries from the type of involvement and participation size along the TDC execution, identifying drivers that facilitate and limit the participation of the beneficiaries’ minority.Minorities, as in any society, have access to fewer opportunities. In the three communities, I found larger minority groups (such as women) than others with less population (such as monolingual), as well as gender norms accepted in the communities, which limit the minority groups from...

Disability is the result of a disease, aggression, damage, or deterioration of health, which forces the individual to stay within a sphere of dependency, therefore in Spain this group has a low citizen participation, since citizen participation, is the intervention of citizens in the public sphere, fulfilling functions of social interests, with a community character that favour democracy and intervene in public decisions. Based on the aforementioned, the objective of this work is to systematically analyse the disability paradigm around citizen participation in Spain, therefore the recommendations were studied by the Committee of the Convention on the rights of people with disabilities, seeking to ensure the suffrage of all these people, independently or assisted by a person they trust, however the privileged scope of citizen participation in Spain is the local level, for which it has bee...

Interactive maps are digital tools that make information available to people in a visual way, in a single set. In addition, they offer the necessary flexibility so that each person can access the information of their interest. These characteristics make these maps an optimal tool to promote citizen participation. A successful example of the use of these maps as a tool to encourage citizen participation is the Mapa Infoparticipa Project, which, with these tools, socializes the transparency levels of local governments in countries such as Spain, Ecuador, Colombia, Chile and Brazil. This article presents what interactive maps are and argues how they are a tool to encourage citizen participation, based on the experience of Mapa Infoparticipa Project.

This research reports on the characteristics and application of health policy in Peru since the 90s, implementing economic measures contained in the Washington Agreement. Specifically on the aspect of privatization to the poorest stratum of the country (rural and urban). Describes the neoliberal politics based on individualism and how Peruvian are divested of a right which is recognized in many treaties, as is health. It presents and analyzes the experience of Local Committees of Shared Administration in Health at national level, recognizing the improvements in the services, but also showing how in the co-management of the services of this sector the State establishes norms and implements the community involvement without decision and without representation; finally the participation is defined as passive and controlled without demeriting that in some places there have been closer result...

Since 2000, women recognized as Afro-Peruvians have always been present at the Peruvian Congress. This fact distinguishes Peru from other countries in the region where Afro-descendant women are widely absent. On the other hand, Afro-Peruvian women included as representatives share characte-ristics such as their origins in families unrelated to politics and an outstanding career as professional volleyball players. Through semi-structured interviews with women identified as Afro-Peruvian who were elected to the Congress of the Republic of Peru this article explores their routes to political power from an intersectional perspective. Instead of the traditional path to power through family ties or the paths of political and community activism, participants in this study exemplify an alternative route to being elected representatives: volleyball. This relationship, however, occurs amid paradox...

In January 2011, the Accounting Standards Board (Consejo Normativo de Contabilidad) recognized profit sharing of employees on tax bases in accordance with IAS 19 Employee Benefits and not by analogy with IAS12 – Tax Income or IAS 37 Provisions, Contingent Liabilities and Contingent Assets. This is based on consultations made to the International Financial Reporting Interpretation Committee – IFRIC, which at its meeting on November 4, 2010, concluded, in respect to the accounting of profit-sharing of employees, which was calculated in accordance with tax legislation, that the recognition of the profitsharing of employees will be in accordance with the provision of the International Accounting Standard 19, Employee’s Benefits, and this is only for the compensation of services provided during the year. Therefore, not should be recorded a deferred tax assets or a deferred tax liability...

In Peru, there is around 1.5 million people with disabilities. But, according to the information from the World Health Organization (WHO), they are about 4.5 million people. Most of them, unfortunately, face a series of barriers to participate in social life, both behavioral and physical environment, which makes this group one of the most discriminated and excluded in our country. Unfortunately, in the current situation of the country, children with disabilities can not fully access education, either due to there is not the necessary infrastructure in educational centers, or due to the methodology of the schools and/or universities does not respond to their particular needs.
