The multi-tiered dispute resolution clauses are a very popular type of arbitration agreement nowadays. These clauses provide that, in order to resolve disputes arising out of a contractual relationship, the parties may or should have recourse to more than one dispute resolution mechanism, which will be used progressively, one after the other. Although this type of covenants may present advantages for the parties, they may also become problematic clauses, which, when inadequately designed or managed, may be a source of additional conflicts to those already arising. For this reason, this article will analyze the main problems that arise in connection with this type of agreement. More specifically, three issues are analyzed in relation to the pre-arbitration stages: their enforceability, the most relevant factors to be taken into account for their execution and compliance, and the consequen...

Introduction: The existence of different reference populations for overweight and obesity diagnosis in children warrants comparative analysis. Objectives: To determine existing differences in nutritional diagnosis using different reference populations. Design: Descriptive, comparative and transversal study. Setting: Hospital Dos de Mayo Growth and Development Section and a Lima Metropolitan State School. Participants: Male and females children aged between 2 and 17 years. Interventions: Two hundred and nineteen children 2 to 5 year-old were studied, as well as 1141 girls and adolescents between 9 to 17 years. In the first group chronic malnutrition (height / age < -2 SD) and obesity (weight/ height > +2 SD) diagnosis was done according to the 1983 National Center for Health Statistics (NCHS) and 2005 World Health Organization (WHO) references. In the second group body mass index (B...

I understand, as Kafka does, that the situation of the bureaucracy of the early twentieth century in Europe in 'The trial’, that corruption has as one of its roots the lack of a sense of community. In this article I propose to overcome the rational choice approach. That way I can combine it with one (that) can understand corruption as collective action. That is why I reflect on the next four key questions to understand this approach: A) what is a collective action problem? this detaches that high levels of trust are significantly related with lower levels of corruption. B) When can we talk about societies where corruption is more the norm than an exception? this deduces that confidence is at stake, specially, in institutions. And c) in which degree the environment determines human behavior in relation with social psychology? Thus, this new paradigm addresses institutions of public admi...

The definition of the state has its origin in law, which in turn is linked to man. In this context, the state is understood as the subject or unit of the legal order in which social life takes place. This article discusses the role of the state in modern society through an analysis of the problems it must face in order to survive and prevail. The challenges that a state must face are many; however, the author emphasizes that the main problems are related to the nature of the state itself. The association of citizens in different political parties and, in particular, the formation of subversive groups that threaten the law have always posed a challenge to social stability. At this point, the author emphasizes that revolution is justified only when a state has placed particular interests above the common good. Other issues may arise from the relationship between church and state, which mus...

This paper presents the preliminary results of a pilot experiment in which prospective elementary school teachers have to solve arithmetic problems from elementary school textbooks related to the use of fractions through a technological environment. The main objective of the experiment, in addition to assessing the knowledge of the future teachers, is to measure the performance of the students based on the type of feedback received after answering multiple choice questions. The data collected allow us to verify the positive impact of using messages with aids compared to using only correct or error messages. On the other hand, we consolidate a methodology to use the measurement of student reading time provided by the technological environment as a proxy to determine the complexity of verbal problems.

The recognition of indigenous rights in the Constitution of Venezuela 1999 represents a conceptual tension in the way of conceiving the citizenship: means transit of a homogeneous citizenship to other multicultural character. However, the realization of those rights has found practical difficulties relating to land titling, lack of political backing for indigenous interests, conflicts with the armed forces, among others, that do lose sight of the conceptual problems underlying the recognition and the construction of citizenship. The aim of this trial, based on a hermeneutic methodology and supported in discourse analysis of documentary sources, will be present some reflections on conceptual tensions that underlie problems of realization of indigenous rights in Venezuela in the last decade, in particular those related to the construction of a multicultural citizenship. The main...

In the present work it is made up of five parts. The first is dedicated to presenting the problem of the exercise of freedom and the consequences that it entails both in the republican and in the liberal model and, of course, it’s different variants. The second part works on the importance of promoting civic values in republicanism, as well as the counterproductive consequences. The third part problematizes if a liberal model can also arrive at a more cooperative and participative position. A distinction is made between psychological egoism (EP), ethical egoism (EE) and rational egoism (ER), to analyze which of the latter fits the liberal model. Finally, in the last part, it is proposed that a cooperative version from a liberal perspective is based, following Nozick, on the «ethical push» and the search to make our lives meaningful. Our main hypothesis is that ethical motivatio...

This text is part of a research paper called: "The influence of ABP on the development of critical thinking skills." Taking into consideration the main foundations established by Barrows (1982) regarding the ABP methodology, this pedagogical practice is introduced as a means to promote PC skills in higher education students. Likewise, the text serves as a reference for the teaching community in its search for the application of new active learning strategies that generate in its students formative aspects of a socio-critical nature with respect to their environment.

This article describes the construction and validation of the “Scale of Social Problems in Chile”. The scale was developed considering the main social issues at a national and municipal level. The instrument was validated using quantitative methodology, with a non-experimental cross-sectional design. The participants were 456 residents of the Valparaíso municipality, Chile. Cases were selected using quota sampling to reflect the demographic composition of the region in terms of the sex and age groups found in the municipality. Exploratory factor analysis was conducted using the Statistical Package for Social Sciences (SPSS) V24.0, while confirmatory factor analysis was performed with R console and the Rcmdr interface. These analyses made it possible to establish that the factor structure of the scale differentiates national problems from local ones.

Migration is a multidimensional phenomenon that, historically, has developed since the emergence of humanity, due to the movements of human groups for different causes or purposes. Nowadays, migratory flows stem from different economic, political and social aspects that are immersed in globalization; for example, capital mobility, job search, ethnic or religious differences, armed conflicts or poverty. These factors have become radicalized over the years to the point where the living conditions of people displaced voluntarily or involuntarily have been violated. Given this environment, spaces for dialogue have been consolidated at a global level and the presence of States such as Peru to evaluate the migration crisis, and reach agreements that allow the establishment of a regulatory framework on this matter at the international and national levels, respectively. Due to what has been expr...

The natural activation of sphalerite during flotation of lead is mainly related to the contamination of lead concentrate. The high content of zinc in the lead concentrate receives economic sanctions by higher refining costs, plus zinc content decreases in its flotation circuit. This research has been conducted on five samples of different minerals to identify the probable causes activation of natural sphalerite. The results indicate that the causes are intergrowths Mineralogical between lead and zinc, and the presence of soluble salts of Cu2 +. The ferrous ions and ferric Fe2 + Fe3 + did not show a significant effect on the activation of sphalerite.

The relationship between the body and the mind has been and still is a persistent dilemma that continues today after centuries of continuous discussions. Both, philosophers, and doctors have advocated diverse theories, with a myriad of questions, and various schools of thought that seek to answer the problem. This review is based on the following question: If we understand the origins of the relationship between body and mind, would the solutions be found in the fields of neuroscience and neurophilosophy? The etymology of the terms, mainly the prefixes “neuros”’ and “psyche”, is studied to delve into the Cartesian conception of the res cogitans and the res extensive. Based on the seven steps of philosophical research, this essay attempts to elucidate the essence of this scientific and philosophical problem contrasting dualism and monism, considering the material and spiritual l...
