The most controversial institution incorporated into the Criminal Procedure Code of 2004 was the sentence of the acquitted, which is the power that the Superior Criminal Chamber has, when resolving the appeal that may have been filed against a previous acquittal sentence issued in favor of the accused (first instance), in being able to amend it in a conviction against this same procedural subject (second instance), sentencing decision that originally could only be questioned by means of the appeal of cassation. In the world of organizations, there are unwanted problematic situations based on principles not discussed but established in practice: making decisions based on concepts and pre-defined paradigms. This approach improves one aspect of the problem, but creates failures in other aspects, which becomes potentially even more serious problems. There are conceptual differences between making decisions and solving problems. The perception of complex problems begins with the identification of holistic elements of the organization: structural, process, human and change dimensions. Problem solving considers three elements: 1) defining the level of resolution or solver position, 2) choice of decision criteria or dimensions relevant, 3) choice of study, formulation and solution tools.

Humans are at the heart of crucial processes in warehouses. Besides the common economic goal of minimising cycle times, we therefore add in this paper the human well-being goal of minimising workers’ discomfort in the context of order picking. We propose a methodology for identifying the most suitable storage location solutions with respect to both goals. The first step in our methodology is to build data-driven empirical models for estimating cycle times and workers’ discomfort. The second step of the methodology entails the use of these empirically grounded models to formulate a bi-objective assignment problem for assigning products to storage locations. The problem of safe obstetrical care has special relevance in recent years due to the interest of health professionals in reducing adverse events and improving healthcare. However, this is pursued in complex, uncertain and variable scenarios and risks, where human behavior may increase the probability of error. We often have to make short term decisions when attending two patients simultaneously – mother and fetus-, and the mother expects a deferential treatment during pregnancy, delivery and the puerperium. These processes involve multiple activities and tasks, and failures may occur. Faced with the paradigm change of involving the patient in the care and decision making process, we have to provide them with the most complete evidence, to avoid contingencies and to obtain the best possible results.

To this extent, most studies focused on business behavior have tried to explain how businessmen behave rather than why they do what they do.
