En sede judicial, la prueba genética goza del privilegio de la irrefutabilidad. A menudo, los jueces emplean este medio de prueba de forma acrítica, es decir, sin ningún instrumento racional. Repensar la prueba de ADN sugiere un desafío que enfatiza la necesidad del diálogo entre Derecho, epistemología y ciencia. En especial, en el proceso de filiación, a pesar de la falta de un análisis epistémico de esta prueba científica, aquella se ha convertido en el instrumento probatorio “ideal” para acreditar la filiación padre e hijo. The data contained in computer and technological devices are increasingly used as evidence in judicial processes, being decisive in the final decisions of judges. This is the so-called computer test. These are often valued uncritically as mere documentary evidence, without considering, among other things, their vulnerable and complex nature. Among the different problems that exist about this test, this study focuses specifically on those related to its reliability. Firstly, the aspects related to the nature of the computer test are examined, as well as its rational assessment. Then, the central question of its reliability is reviewed, related to the risk of its manipulation and its impact on it. In court, genetic evidence owns the privilege of irrefutability. Judges often use this means of proof uncritically, in other words, without any rational instrument. Rethinking DNA testing suggests a challenge that emphasizes the need for dialogue between law, epistemology and science. In particular, in the filiation process, despite the lack of an epistemic analysis of this scientific test, it has become the “ideal” evidentiary instrument to prove parent-child filiation. El trabajo analiza los nexos entre el deber de motivación de las resoluciones judiciales con la iniciativa probatoria del juez. Adhiriendo a la concepción epistemológica de la prueba y el de la motivación como justificación racional de la decisión, el Autor pone en evidencia la necesidad de que la resolución con la que se disponen pruebas de oficio, esté racionalmente justificada, proponiendo los corres-pondientes criterios.
