Legitimacy of criminal sanction is originated on its own purposes pursued in a state governed by the Rule of Law. That legitimacy should include the penalty as well as security measures, bearing in mind that both are imposed to someone breaking a rule of conduct, and therefore, someone capable to do it. This article starts by analyzing the concept of Due Process and its scope over the administrative procedures. Also, the concept of the Right to Evidence, as an element of Due Process, is explained. Then, an analysis of the relationship between the supervisory procedures and the Due Process is developed, in order to check whether if its requirements are fulfilled by the Public Administration in order to obtain a Valid Evidence after a monitoring or an inspection. Finally, the analysis is focused on the actions of the Peruvian Regulatory Agencies, specifically, during the issuing of an Inspection Report after a Supervisory Procedure.

Objective: To determine how the functional barriers faced by MSE in the textile and clothing sector influence the exportable supply. The functional barriers that were identified are: Human Resources, Production and Finance. Method: The present investigation is defined under the quantitative approach, descriptive and correlational type and non-experimental design. Results: The population and sample is not probabilistic or directed, it is conformed by fourteen (MSE) from the textile sector, which have exported between the years 2006-2016 and have been in the process of internationalization on a regular basis for a period of not less than five years. Even when it is a practical issue, these statistics have complex nonstandard distributions depending on functionals of certain stochastic processes, and their derivations represent a barrier even for many theoretical econometricians. The technique involves the injection of water-soluble contrast material within the bone of the spinous process of the last lumbar vertebrae, in order to obtain the normal or pathological radiological imaging of the inferior vena cava . Proceduralist doctrine has been debating intensively the principle of legality/discretionary prosecution principle dichotomy, without the necessary consensus about this extreme having yet been achieved to date. In Spain, the controversy still focuses on the convenience or not of incorporating now into the system the most relevant manifestations of the centennial Law of Criminal Procedure despite the successive reforms of this norm that have been introducing manifestations of the discretionary prosecution principle. Thus, this article seeks to determine if a criminal process must be informed by the discretionary prosecution principle, and to what extent it must be, constitutes, in short, an option of legislative policy that must be exercised taking into account the Constitution of each country and the role that is attributed to criminal law and criminal procedure law.

This article addresses the relationship between the Process and the Constitution. For this purpose, it is explained what is the object of study of the Procedural Law, and which is the litigation model adopted in article 139 of the Peruvian Constitution, why this model is about a system with its own autonomy and substantivity and not about a subsystem, and how Civil Law and Common Law converging in this model. Furthermore, the author establishes, based on the Constitution, the reason why the existing procedural guarantees in our legal system do not imply a “right to a right decision”, but only the right to a fair process, and explains the difference between “fair process” and “justice” or “judicial truth”.

This paper highlights the need to examine the role of a constituent assembly within a democratic and constitutional system. To this end, a detailed analysis of the issue is undertaken on the basis of doctrine and constitutional history. It is concluded that the purpose of a constituent assembly is to establish a constituent power and to reform the constitution.
