The text examines the relationship between three key institutions: intellectual property, artificial intelligence, and human rights. In a legal context of state obligations, it discusses the protection of rights for individuals in Mexico, users of 4.0 technologies, and the legal uncertainty regarding the recognition of their intellectual creations. It explores the principles of intellectual property and its link to artificial intelligence, understood as the ability of machines to imitate human intelligence. Legal frameworks in Mexico and globally are discussed, linking them to human rights, concluding with the study of human control as an emerging but applicable right.

To this end, the three classic and historical categories of dignity are analysed: ontological, theological and ethical. The analysis of binary conceptual systems includes "man and woman" as paradigms of opposite categories. In many cultures, the use of the categories "woman and man", to facilitate thinking, seems to be part of an ordering system in which women are placed on the less valued and inferred side of the opposition. Thus, some authors have suggested that women are to men, what nature is to culture. Others have drawn attention to the way in which the left or right hand is used to express gender differences, in the words of Evans Pritchard, "a slight organic asymmetry becomes a symbol of an absolute moral polarity" (1973).

This paper highlights the humanistic aspect of human rights within a globalized world, and particularly in government policies, which has neglected the importance of human rights in overcoming many conflicting aspects of our society. In this perspective it becomes clear the condition of human nature, from its ontological root, which gave rise to and foundation for Universal Human Rights, leaving certain relativistic, subjectivist and even reductionist approaches that do not respond to the vision integral of the person.
