This article addresses how the right to dignity and the principle of vulnerability of the human person have been transgressed within the process of sheltering victims of human trafficking, emphasizing that rescuing them implies the first contact they have after of having experienced a series of denigrations and serious violations of their most basic fundamental rights, understanding that trafficking has different types, however, in the sexual type, the victims are those who have a very deep selfdepreciation, because in a period of time. Seizure, by virtue of Plenary Agreement No. 05-2010/-CJ-116 of the Supreme Court of Justice of Peru, is divided into: (a) seizure for evidentiary or instrumental purposes (art. 218 of the Criminal Procedure Code); (b) seizure for coercive or precautionary purposes (art. 316 of the Criminal Procedure Code). In tax investigations for crimes against the public administration, it is vitally important to know how to use and distinguish both forms of seizure, since each tax case has different facts and particularities. This research article will analyze and delve into seizure for evidentiary purposes as an effective instrument in tax investigations for crimes against the public administration, developing the procedure to follow and the main problematic scenarios that may arise in its use; for example, the distinction between a voluntary delivery of a seizure, if first of all seized property or...

This article originates from the problem that has been observed in the prosecution and punishment of computer crimes, since many of these criminal cases usually go unpunished. In this line of ideas, through the aforementioned study, the factors that contribute to the non-criminal punishment of cybercriminals will be fully identified. One of these factors is the non-individualization of the cybercriminal, which is why the representative of the Public Ministry usually files the criminal process, for a simple reason: the formalization of the preparatory investigation requires the full individualization of the subject, otherwise, the investigation cannot be formalized. In order to avoid impunity for computer crimes, this research will provide certain solutions that will contribute to the investigation and punishment of these criminal acts.

The objective of this article is to identify the legal bases that serve to defeat the rule that regulates the prohibition of early termination in crimes against sexual freedom (third paragraph, article 471 of the Criminal Procedure Code). The need for such an urgent proposal lies in the fact that such a prohibition does not benefit the interests of the victim, but, on the contrary, generates situations of tension, such as: (a) increases the possibilities of re-victimization; (b) generates greater economic costs for the procedural parties, including the victim; (c) promotes untimely justice; and, (d) generates cases of impunity. Therefore, the research will focus on analyzing whether the principle of non-revictimization; the principles of economy and procedural speed; and, effective justice, are necessary foundations to defeat such a norm.

Sexual violence is a multidimensional problem with an increasing incidence, its consequences generate short and long term havoc on the victim, as well as on society. The immediate and timely statement of the aggrieved minors for sexual violence is transcendental in the prosecution of the crime carried out by the Public Prosecutor's Office. The reception in Gesell camera, due to the fact that it is an anticipated evidence, has the objective of individualizing the perpetrator. It must be carried out avoiding the revictimization of the aggrieved minor and with unrestricted respect for the right of technical defense of the person to identify himself in the respective statement that, in this case, will be represented by the Public Defense to guarantee the legality of the diligence and the due process. The pronouncement of the jurisdictional organ before the prosecutor's request for the anticipated evidence of a minor victim of rape must be resolved with a constitutional perspective. Priority must be given to the right to effective protection, the principl...

Significant advances in computing, telecommunications, and the internet have driven social, economic, and political progress, leading to a paradigm shift: from common crime to cybercrime. Cybercriminal activity has expanded globally, giving rise to new forms of illicit conduct and criminal activity online. This phenomenon has spread worldwide, resulting in punishable actions in cyberspace, committed through social networks, digital media, online environments, and mobile or technological devices. Consequently, legislators have had to restructure and adopt regulatory tools to prevent such crimes. Cyberspace lacks borders and legal regulations, which gives cybercriminals an advantage due to high complexity, anonymity, lack of evidence, and procedural legislation regarding electronic evidence. Currently, the role of the Public Prosecutor faces numerous challenges in the justice system, makin...
