El presente trabajo de investigación, hace referencia a la urgente necesidad de reformular el derecho penal tradicional, orientado a una lucha eficaz contra el crimen organizado y el delincuente potencialmente peligroso que ha sometido a nuestra sociedad, asignándole la etiqueta que vivimos en una creciente inseguridad; donde la política criminal aplicada en este tipo de delitos es ineficaz, lo que se agrava con la corrupción en los operadores del derecho, que acrecienta la impunidad de estos delincuentes peligrosos. En ese contexto, se trazó como objetivo, fundamentar que dentro de un Estado de Derecho, es necesario reformular el sistema penal y establecer un derecho penal funcional, como respuesta eficaz, ante la creciente inseguridad.
