RESUMEN La presente investigación se realiza con la finalidad de determinar de qué manera el delito de atentado contra las condiciones de seguridad y salud en el trabajo incide en el principio de legalidad penal y el principio de mínima intervención penal. En el sub capítulo I del marco teórico, se desarrolló todo lo concerniente a la tipicidad objetiva y subjetiva del delito de atentado contra las condiciones de seguridad y salud en el trabajo, haciendo una especial incidencia en la tipicidad objetiva, respecto a las modalidades típicas, a la configuración de la condición objetiva de punibilidad y respecto al bien jurídico que protege el delito in comento. Seizure, by virtue of Plenary Agreement No. 05-2010/-CJ-116 of the Supreme Court of Justice of Peru, is divided into: (a) seizure for evidentiary or instrumental purposes (art. 218 of the Criminal Procedure Code); (b) seizure for coercive or precautionary purposes (art. 316 of the Criminal Procedure Code). The alternative indictment is regulated in the current Peruvian Criminal Procedural Code of 2004 as part of the discretionary and inherent powers of the Government Attorney General’s Office as the operator of the criminal action and head of the investigation. Its use has increased in complex and hypercomplex criminal proceedings, in which the representative of the Government Attorney General’s Office applies more than one charge for the fact being prosecuted, creating issues in its use and application, both for the Government Attorney General’s Office and for the defense. In this sense, this research will analyze and delve into the nature and purposes of alternative indictment, the infringement or not of the rights of the defendant when using this option, its use in personal preliminary injunctions, among other aspects.
