The documents required for this potential transfer have essential characteristics that must be respected throughout the procedure. This article discusses the necessary linkages that must exist between the State and the dialogue. To propose that the State is the space for dialogue par excellence, the text relies on the ethical nature that is inherent in the constitution of the State. Furthermore, the State represents a strategic and forward-looking perspective for human life in the world that is expressed and founded on such important issues as equality, recognition and democracy. This article carries on an analytical review of literature on negotiation and mining conflicts, particularly in Peru. It also seeks to identify important theoretical recommendations offered by this literature.These recommendations serve to problematize future research on the challenges of these negotiation processes and their ability to overcome disagreements. «Conformidad» is a very old institution in the Spanish criminal procedure system, since it dates back to the 19th century. It shows an exercise whose objective is to get the students or participants to design the strategy they will follow during a negotiation process, taking into account the basic principles of a price negotiation. It simulates a typical negotiation between a buyer and a seller, each of whom has information that the other does not know. Each party must negotiate the price at which it will be willing to enter into the transaction. A second objective is to record the evolution of the negotiation process in order to measure the strength and sequence of the arguments, as well as the style of the negotiation. To this end, the instructor's guide suggests that the participant should define his strategy, prepare the arguments with which he will support it and define his negotiation style.

The Free Trade Agreement between Peru and China has as characteristics a long process of gestation and a brief process of negotiation. Tariffs benefits agreed allow for the great majority of potential Peruvian exports products to have access to tariffs reductions. On the other hand, almost all Peruvian products sensitive to Chinese competition were excluded from the tariff reduction process or were included with up to 17 years of tariffs reductions. After nine years of entering into force, it is concluded that the agreement has been beneficial for Peru, notwithstanding the essential characteristic of its trade structure: that of being interindustrial.

This article deals with the preparation process for the negotiations of the Free Trade Agreement between Peru and the United States. It also deals with the internal coordination process developed in order to successfully negotiate with the United States, as well as to obtain support of the relevant domestic actors.It is argued that the activities related to preparation, organization, coordination and information were a fundamental element for the success of these negotiations with our most important trade partner of the time, being also the first free trade agreement negotiated outside Latin America.

El presente estudio parte de la problemática que presenta una empresa del sector lácteo en la distribución de venta comprendida en la zona norte del Perú, la cual mediante la implementación de la herramienta de ingeniería Matriz Impacto-Factibilidad, para poder elegir mediante ranking de factores la mejor opción de las desplegadas en la Lluvia de ideas, logró un incremental de 14% en nivel de ventas brutas, una reducción en descuentos por venta del 64%, considerando el mayor poder de negociación e implementación de estrategia comercial de la empresa en comparación del distribuidor, obteniendo por consecuencia un incremental de 16% en nivel de ventas netas.
