The enforceability of awards is the most valued feature of arbitration. This alternative dispute resolution mechanism depends, almost entirely, on the efficiency of the final product it provides: the award. The quality of this instrument, however, may vary depending on the arbitrators in charge of rendering it and, most important, the institutions that fulfill the function of regulating the arbitral procedure.In this article, the authors propose that arbitral institutions in Peru implement the scrutiny of awards in order to improve the quality and enforceability of awards. The commercial operations of the modern world are complex and often present a series of equally sophisticated disputes. The old contractual models and their remedies are not sufficient to cover the current dynamics, this is the case of related operations that require efficient tools for their solution.In this context, the author develops a series of techniques or mechanisms for the efficient and effective solution of the identified problems, consolidation and suspension. It proposes that these mechanisms respond to the contractual mechanics of the current trade, which involves a series of intricate and related relationships, grouping in a single process the solution of the controversy.Likewise, the advantages and elements required by these mechanisms to operate will be analyzed.

The Prague Rules are intended to provide efficiency and reduce costs in conducting arbitration proceedings. The Rules are based on the position that the practice and procedure of international arbitration is too heavily influenced by the adversarial system found in common law jurisdictions, and that the inquisitorial judicial practices of civil law jurisdictions are more conducive to a “streamlined procedure”. In this paper, the authors first consider whether this predicate is accurate and fair. Are adversarial practices the source of inefficiency in international arbitration, or can the reasons be found elsewhere? In the last decades, different public and private initiatives for closing gender-gaps in professional environments have been designed, presented and implemented. Likewise, these initiatives also aim to progressively strengthen female representation on the aforementioned environments. In this new landscape, alternative ways of resolving disputes have emerged that go beyond the courts, such as arbitration. The General Arbitration Law provides for the possibility of applying for pre-arbitration interim measures; however, it does not detail specific provisions regarding the securing of evidence by the jurisdiction prior to the commencement of arbitral proceedings. In this context, it is common that, prior to arbitral proceedings, situations arise in which it is necessary to resort to the jurisdiction to collect and protect evidence. Efectuando especial mención respecto a la figura de vicios ocultos en las contrataciones de bienes, en este caso, bienes perecibles y cuestionaremos la lógica del tribunal al considerar cumplidas las obligaciones del Contratista. Arbitration is the mechanism most widely used worldwide in resolving construction disputes. Nonetheless, arbitration faces challenges related to its costs and length. This phenomenon has caused the study and the proposal of several recommendations in construction arbitration, which embodies the best practices in the mitigation of the inefficiencies under analysis. During the development of an expert report, difficulties arise that may have a significant impact on its probatory value. This can be noted in the selection of the expert; in determining the scope of the report; in the form of access to the documentation of the process; in communications that the expert may or may not have with the parties, their respective experts, and with the arbitrator; in the selection of methodologies to evaluate costs and extensions of time; in legal matters related to the technical aspects of the report; in the expert hearing; and in the content of the report itself. The Peruvian Arbitration Law was inspired by the UNCITRAL Model Law on International Commercial Arbitration. Both rules empower arbitration tribunals to issue anti-process or anti-suit injunctions. These measures classified as precautionary measures aim to protect the jurisdictional monopoly granted by the parties to the arbitral tribunal to address the risk of two parallel proceedings and two contradictory decisions being issued. However, despite appearing to be a useful remedy in arbitral material, it has certain questions that diminish its application.In this article, the authors analyze such measures to address the questioning that limit its application to verify their efficiency and validity. It also assesses its requirements under international arbitration practice to corroborate whether they conform to the Peruvian regulatory framework.

Judicial review of the awards in Peru is in practice problematic and incomprehensible. Even though the law expressly forbids the judicial analysis of the reasoning of the award, in reality more than the half of proceedings for setting aside an award are based on objections to its reasoning. In view of this situation, it is essential to understand which are the “defects” in the reasoning that renders void the award, in order to not commit them. This paper seeks to propose guidelines that allows arbitrators to avoid the annulment of the award due to its reasoning.

The last 30 years have been a really exceptional time for international arbitration. The author resembles international arbitration with the SevenKingdoms of “Game of Thrones” where everything went right under the umbrella of the New York Convention.Gary Born states: “Winter is Coming” for international arbitration. The arbitration community should be prepared to defend itself from a metaphorical “armyof undead” who could demand more government control of the arbitration process in the future. One of the great similarities between an ordinary judicial process and arbitration is that both take time. However, in arbitration, unlike in court proceedings, certain measures provided are intended to respond to an adequate use of this resource in the process. In general terms, the current legal standards for granting extensions in arbitration are the equality of arms or opportunities and the reasonableness, both duly recognized in the Peruvian Arbitration Law. In this article, the authors review the sufficiency of this standard from the perspective of an economic analysis for each of the phases of the arbitration process and, in this way, propose its use as an approach for the evaluation of reasonableness when having to decide whether to grant an extension in an ongoing process.

The aim of the study was to describe methodological mastery principles in the professional competence of the scientific referee. The study was conducted between January and February 2024. Three manuscript evaluation forms corresponding to the guidelines for scientific arbitration from the following journals were selected: Acta Biológica Colombiana, Colombia; Revista Internacional de Contaminación Ambiental, Mexico; and The Biologist (Lima), Peru.
