One of the great similarities between an ordinary judicial process and arbitration is that both take time. However, in arbitration, unlike in court proceedings, certain measures provided are intended to respond to an adequate use of this resource in the process. In general terms, the current legal standards for granting extensions in arbitration are the equality of arms or opportunities and the reasonableness, both duly recognized in the Peruvian Arbitration Law. In this article, the authors review the sufficiency of this standard from the perspective of an economic analysis for each of the phases of the arbitration process and, in this way, propose its use as an approach for the evaluation of reasonableness when having to decide whether to grant an extension in an ongoing process.

The construction industry is highly conflictive and adversarial. Given the existence of clauses that generate an evident imbalance between the parties and where the solutions proposed to result in the benefit of only one party, the need to incorporate collaborative practices that promote active and reciprocal cooperation between the parties during all stages of the project becomes more evident. This article aims to recommend three practices that, if included in the construction contract, help to carry out an efficient contract administration, to reduce the potential for possible conflicts, and, with it, to prioritize the project’s objectives.

A pesar del amplio desarrollo del arbitraje en Perú, la práctica arbitral peruana aún continúa batallando con la inclusión de defectos en la motivación como causal de anulación del Laudo. Si bien la doctrina señala que el laudo puede ser anulado por algunos limitados asuntos relacionados a la motivación, aún quedan preguntas por responder como: qué estándar de motivación deben aplicar las Salas Comerciales para revisar la motivación del laudo y si es posible hablar de buenas prácticas para la anulación de un laudo por motivación. El presente artículo pretende responder estas preguntas mediante el análisis teórico y práctico del sistema arbitral y analizar la evolución del sistema peruano a partir de un repaso jurisprudencial de aciertos y desaciertos de las Salas Comerciales.
