Society has witnessed the progressive transformation that justice has undergone over time. In this new landscape, alternative ways of resolving disputes have emerged that go beyond the courts, such as arbitration. Although arbitration has distinctive characteristics that differentiate it from conventional dispute resolution, the authors point out that this type of administration of justice cannot be judged without knowing its history, its purpose and how it actually works. It is not, therefore, a "heresy" in the evolution of law. To that extent, this article deals with the conceptualisation of arbitration, but not before having analysed its nature. This paper aims to study the development of arbitration in Peru, taking into account the foundations that gave rise to its emergence, the legislative advances over time and will focus on analyzing the popular arbitration that has arisen as a result of all the mentioned advances, which has given way to a new popular justice. The first part will make a brief introduction of the different conflict resolution mechanisms and the crisis through which the Peruvian official justice system goes through. This paper analyzes the development of arbitration as an alternative means of conflict resolution in Latin America, especially since the 1990s. En el presente artículo el lector se verá sumergido en un interesante debate acerca de los distintos métodos de educación legal utilizados en nuestro país. Por un lado, tenemos la postura de la Dra. Zusman quien en su ensayo nos señala la necesidad de que los estudiantes de Derecho,más que acumular conocimientos, deben “aprender a aprender”, habilidad que no se logra en clases magistrales sino en talleres donde se desarrollan el razonamiento y la investigación.
