Objective: To determine the incidence of the Affectation process in the use of the properties in the management of the real estate of the State administered by the National Superintendence of State Property, period 2012 - 2016. Method: It is a substantive, explanatory, quantitative, transversal research and a retrospective, correlational and non-experimental one, based on measurement, numerical evaluation and statistical analysis. This paper sets out to analyze some new rules of the New Criminal Procedure Code linked with the regulation of the civil action exercise in the criminal proceeding. The author indicates that the civil liability that is required in the criminal proceeding does not derivate from a commission of a crime: the crime has the penalty as a consequence and the civil wrong a civil penalty. The civil actor has to be interested on the existence of a damage, not that the fact that it is based on be a crime. Mine equipment selection is a complex task due to numerous technical, geometrical and economical variables involved. The variety of equipment manufacturers and agents carrying different models, types and sizes make the selection procedure even more complex. The mine planner does not have a tool to correctly select the equipment or fl eet for a project. Simulation fi lls the gap and contributes to this goal.
