La Modernidad, de la que somos hijos y de la cual nuestro derecho contemporáneo se ha nutrido, introdujo una forma de comprender y hacer el derecho que a la vuelta de los años se ve insuficiente y reductiva. De un lado, entroniza a la razón teórica como prototipo de la racionalidad jurídica y de otro, pone a la norma como eje de lo jurídico. El presente artículo se centra en el análisis de la literatura producida por Robert Alexy, reconocido jurista alemán, centrada en el concepto de los derechos fundamentales los cuales son, en un estado constitucional de derecho, el fin último del ordenamiento jurídico. Así, para Alexy los derechos de las personas no son de tipo moral, sino más bien, jurídico. Es en ese sentido y tomando como premisa de partida la concepción de los derechos fundamentales que la autora propone una lectura tentativa desde una perspectiva realista moderada de algunos aspectos de la posición teórica de Alexy.

El tratado Nociones y elementos de arquitectura, de Héctor Velarde Bergmann (1898-1989), fue publicado en 1933 por la Escuela Militar de Chorrillos como material de enseñanza del curso impartido con el mismo nombre en el quinto año de Ingeniería. Assessment is a key aspect of the teaching and learning process. Teachers at the university face the challenge of identifying the best strategies to carry out this process effectively in remote teaching. This paper offers a balance of the debate between morality (Moralitdt) and ethical life (Sittlichkeit) that acted as conceptual framework ot the controversies on morals over the past decades. lt is here shown that, in spite of the different tentatives to find a way to reconcile both paradigms, thc debate has not had a positive outcome. The reason of this failure lies in the conflicting interpretations on the notion of practical rationality. This thesis is obtained from an immanent analysis of the debate's development.

El presente artículo es un balance del debate entre moralidad y eticidad que durante las últimas décadas sirvió de marco conceptual a las controversias de la moral. Se muestra aquí que, pese a los diferentes intentos por hallar una forma de conciliación entre ambos paradigmas, el debate no ha tenido un desenlace positivo. La razón de este fracaso radica en el conflicto de interpretaciones sobre la noción de racionalidad práctica. Esta tesis es extraída de un análisis inmanente del desarrollo mismo del debate.

This article focuses on the analysis of the literature produced by Robert Alexy, a renowned German jurist, focusing on the concept of fundamental rights, which are, in a constitutional state of law, the ultimate goal of the legal system. Thus, for Alexy the rights of people are not moral, but rather legal. It is in this sense and taking as a starting point the conception of fundamental rights that the author proposes a tentative reading from a moderate realistic perspective of some aspects of the theoretical position of Alexy.

Kant' s jurídical and polítical meditations fit inside the critical system as a proyect that faces the challenge of building a bridge between liberty and nature. In this sense, law, conceived by Kant as categorical imperative, must accomplish the task of conciliating the need to reform the State in order to achieve justice with the preservation of an irresistible civil authority. The polítical problem is, then, to resolve the conflict between liberty and order. The polítical antinomy (empiricism vs. fanaticism) is resolved with the definition of a practical rationality based on the publicity of polítical rules. Without abolishing the difficulties of Kant's jurídical philosophy, this solution allows to define an intersubjective space of polítical rationality, both free of jurídical positivism and decisionism as well as of historicism or of the dictatorship of a fanatical reason.

Constitutional rationality dictates that procedural safeguards will be balanced in order to consider the interests of both parties that in this case are opposed in a controversy. The concept of rationality is analized by the author as a value that goes beyond the scope of the legal right, that is, as a constitutive element of the homo sapiens. This is the reason why the conviction is spread among constitutionalists and legal philosophers  that the principle of practical rationality has assumed the rank of constitutional value because of the constitutionalization of human rights. All of this is explained in the prospective of the civil process, where the constituent has instituted the guarantee of the appeal in order to guarantee equality in the treatment for the procedural parties.

With respect to the axes that articulate Spinozian thought, they are summarized in three aspects: It is a metaphysical proposal, since a rational order underlies nature that starts from the idea of God; epistemic, since the intellect can know and identify this order; and ethics because from knowledge, a lifestyle is adopted, based on the effort that will give meaning to moral behavior. In this sense, the purpose of this article will be the role played by the concept of Conatus that would represent the aforementioned effort, around a practical rationality, exposed by Spinoza in the fourth part of his Demonstrated Ethics according to the geometric order, whose theme It lies in the deep link between ontology and morality, since philosophy not only tries to answer the question of what the world is, but also the problem of how we can live better in it.
