The process of the transfer of forestry functions, which began in 2009, was not completed; 15 Regional Governments have yet to assume the functions of monitoring and control; as well as administration and control of the forestry and wildlife resource (RFFS acronym in Spanish), provided for in the Organic Law of Regional Government (Article 51°). This situation is due to weaknesses inherent in the decentralization process at the national level, coupled with the weak leadership of SERFOR to lead the decentralization process and promote the decentralized management of RFFS, and, to the little interest of the Regional Governments in assuming these functions. This led an unclear and changing organization, weak operational capacity and capacity-building; among other problems, which have always affected the forest sector; this is the case with deforestation and corruption associated with harve...

This article starts by analyzing the concept of Due Process and its scope over the administrative procedures. Also, the concept of the Right to Evidence, as an element of Due Process, is explained. Then, an analysis of the relationship between the supervisory procedures and the Due Process is developed, in order to check whether if its requirements are fulfilled by the Public Administration in order to obtain a Valid Evidence after a monitoring or an inspection. Finally, the analysis is focused on the actions of the Peruvian Regulatory Agencies, specifically, during the issuing of an Inspection Report after a Supervisory Procedure.

Peru is one of the countries most exposed to catastrophic events worldwide such as: floods, debris flow, tsunamis, earthquakes. Particularly, earthquakes are generated by the interaction of the Nazca and South American plates known as the subduction process and shallow faults. Likewise, another major problem that Peru is going through is informality in construction, which, added to a large earthquake, could bring with it great economic losses and human lives. Therefore, these problems have motivated the development of this research, which aims to evaluate the seismic risk of buildings in the district of Ayacucho - Peru. In this sense, the probabilistic seismic threat is evaluated using the R-CRISIS program, accompanied by geophysical studies such as MASW (Multichannel Analysis of Surface Waves) that allow the soil to be characterized based on shear wave velocities. Furthermore, the seism...

This paper discusses the changes to the rulemaking process performed by the National Health Authority (ANS) during a decade, as an expression of the exercise of its health-related regulatory function. Before the implementation of said changes, the initiative for rulemaking was freely taken by the proposing entities. This situation led to an increased risk of mistakes, and the lack of a standardized methodology and an organized structure of the Regulatory Documents (DN) to be approved by the Ministry of Health. As a result, the National Health Authority decided to organize and standardize the process, in order to reduce the risk of mistakes during such rulemaking process. Based on the revision of the health-related rulemaking performed by the Ministry of Health for the period 2006 - 2015, which was published on the Legal Standards supplement of El Peruano official gazette, the legal stand...

The most controversial institution incorporated into the Criminal Procedure Code of 2004 was the sentence of the acquitted, which is the power that the Superior Criminal Chamber has, when resolving the appeal that may have been filed against a previous acquittal sentence issued in favor of the accused (first instance), in being able to amend it in a conviction against this same procedural subject (second instance), sentencing decision that originally could only be questioned by means of the appeal of cassation. However, the national legislator, through Law No. 31592 of October 26th 2022, has decided to briefly reform this adjective norm, where the legal novelty is that this convicted person has the possibility of challenging his sentence via a new appeal, in which the Criminal Chamber of the Supreme Court is enabled to act as a judicial instance, this according to the exclusive rules of ...

The application of different unit root statistics is by now a standard practice in empirical work. Even when it is a practical issue, these statistics have complex nonstandard distributions depending on functionals of certain stochastic processes, and their derivations represent a barrier even for many theoretical econometricians. These derivations are based on rigorous and fundamental statistical tools which are not (very) well known by standard econometricians. This paper aims to fill this gap by explaining in a simple way one of these fundamental tools: namely, the Functional Central Limit Theorem. To this end, this paper analyzes the foundations and applicability of two versions of the Functional Central Limit Theorem within the framework of a unit root with a structural break. Initial attention is focused on the probabilistic structure of the time series to be considered. Thereafter...

Legitimacy of criminal sanction is originated on its own purposes pursued in a state governed by the Rule of Law. That legitimacy should include the penalty as well as security measures, bearing in mind that both are imposed to someone breaking a rule of conduct, and therefore, someone capable to do it. Reviewing penal capacity or criminal liability concepts is required because if penal capacity means the capacity to understand the reality and adjust the behavior to it, and if every legitimate criminal sanction have to be imposed to someone who have the capacity of break it, then security measures also have to be imposed only to people responsible, capable to understand rules and act in accordance. With regard to people not subject to criminal liability they are standing outside Criminal Law and punish them would be illegitimate. In this line, criminal liability should be seen not only a...

The objective was to apply RMySQL, dplyr and graphing functions of the database to the processes of admission at the Central Admission Commission at the National University of the Altiplano. The source code of the functions that return data.frames of the observations of the database and functions was implemented to generate the graphs of dynamic form such as ggplot and barplot; summarise, select, group_by, merge, arrange, unique and others of project R were used. The result indicates that the percentage of entrants, of the ordinary and extraordinary admission processes, according to the number of applicants is: 22.91% were admitted to Medicine, Veterinary and Animal Science; 10.87% to Nursing; 26.83% a Biology; 2.44% in Human Medicine; 17.64% to Human Nutrition and 7.25% to Dentistry, included between March 17, 2013 and January 22, 2017; also, the percentage of admissions by or...

Proceduralist doctrine has been debating intensively the principle of legality/discretionary prosecution principle dichotomy, without the necessary consensus about this extreme having yet been achieved to date. In Spain, the controversy still focuses on the convenience or not of incorporating now into the system the most relevant manifestations of the centennial Law of Criminal Procedure despite the successive reforms of this norm that have been introducing manifestations of the discretionary prosecution principle. Thus, this article seeks to determine if a criminal process must be informed by the discretionary prosecution principle, and to what extent it must be, constitutes, in short, an option of legislative policy that must be exercised taking into account the Constitution of each country and the role that is attributed to criminal law and criminal procedure law.

This paper highlights the need to examine the role of a constituent assembly within a democratic and constitutional system. To this end, a detailed analysis of the issue is undertaken on the basis of doctrine and constitutional history. It is concluded that the purpose of a constituent assembly is to establish a constituent power and to reform the constitution. Constituent power is the ability of a society to create or reform fundamental rights and the structure of government. Thus, the Constituent Assembly is the way in which the people exercise this power with the aim of amending the existing constitution or creating a new one. However, the author points out that there is one element that cannot be excluded by this power, and that is constitutional democracy. In this sense, this article provides a detailed study that helps to understand what a Constituent Assembly implies as a key enti...

The largest Kamari ista (banquet or festival of abundance) in the entire Kichwa-speaking Amazon is celebrated in the community and rural parish of Canelos, in the Pastaza district in the province of the same name, in Ecuador. Based on a request from the same community for the Kamari to be registered and certified as national heritage, between 2013 and 2022 participatory ethnographic work was carried out to prepare the base document for said goal. In this process, it became evident that, beyond certain ethnographic works from several decades ago, little is known today about this festival or ritual, its function and meaning. Starting from the work carried out within the framework of heritage certification, the objective of this article is to analyse the Kamari of Canelos from an anthropological perspective: its complex process of preparation and development, its intercultural origin, and e...

The relationship between family functioning and differentiation of self has been established by classical systemic authors, but little explored by empirical research, especially in Brazil. This quantitative study aimed to analyze the relationship between family functioning and differentiation of self of Brazilian university students. Eight hundred undergraduates of both genders participated in the research, with an average age of 22.7 years. It was found that students with higher levels of differentiation of self perceived family communication and satisfaction more positively. Tangled families proved to be the least favorable to the differentiation process. It was found that males and older undergraduate students displayed higher levels of differentiation. Finally, university students with higher levels of differentiation, who belonged to families regarded as healthy, were more satisfied...

Mathematics are fundamental in various areas of science, and although teaching it presents challenges, using technology in the classroom offers an opportunity to enhance the learning process, allowing a deeper understanding of concepts and their application in real contexts. In light of this, the current research evaluated the effectiveness of the PhET simulator in teaching the topic of graphing quadratic functions to upper secondary students, aiming to identify the impact of this educational technological tool on their learning. The study was quantitative with a descriptive scope and a pre-experimental design. Prior to the implementation of the treatment, a written questionnaire was applied to students in their fourth semester at Conalep Plantel Tizimín (Yucatan – Mexico), which served to measure their knowledge on the subject under study. After the treatment, the questionnaire was r...

Intelligence is a construct of notable impact in our sociocultural context, related to a wide range of conceptual and operational definitions which originate positions that highlights cognitive and abstract elements and emotional and social skills, as well was perspectives that are focused on processes underlying the intelligent performance, such as in the case of executive functions (EFs), which are configured as cognitive processes that make it possible the self-regulation (Miyake & Friedman, 2012). Similarly, there are approaches that give intelligence a relevant and predictive role of school performance, an aspect strengthened by the psychometric perspective, where the concept of intelligence has been closely linked to learning. In this line, we also find the classical perspective of crystallized Intelligence of Cattell (1943), which refers to the knowledge acquired through educa...
