The text analyzes the electoral system and political representation in Peru, highlighting the democratic transition initiated in 1980 after a period of military rule. It is emphasized that the 1979 Constitution strengthened the Executive Branch, established a bicameral system and promoted decentralization through the creation of local governments. Likewise, with respect to the electoral field, it highlights the adoption of the single ballot paper, the “cifra repartidora” and the scrutiny at the polling station, implemented since 1963, which contributed to minimize electoral fraud and to guarantee more transparent processes. This paper highlights the need to examine the role of a constituent assembly within a democratic and constitutional system. To this end, a detailed analysis of the issue is undertaken on the basis of doctrine and constitutional history. It is concluded that the purpose of a constituent assembly is to establish a constituent power and to reform the constitution. Constituent power is the ability of a society to create or reform fundamental rights and the structure of government. Thus, the Constituent Assembly is the way in which the people exercise this power with the aim of amending the existing constitution or creating a new one. The enactment of the General Law on the Donation and Transplantation of Human Organs and/or Tissues, Law N.º 28189, and its Regulations, Supreme Decree N.º 014-2005-SA, has aroused the interest of the medical community. This is due to the approach that these regulations, especially the latter, have taken to the medical and legal determination of death. This paper examines the political and criminal implications of Jakobs' recent conception of the Peruvian judicial system within a state where the Constitution is the supreme rule. The analysis highlights the shortcomings of Jakobs' thesis of positive general prevention in relation to the function of criminal law in our legal system. The article argues that Jakobs' approach disregards important constitutional principles and fails to consider fundamental rights that protect individuals from excessive use of punitive power by the State. This can lead to a dangerous weakening of the role of the courts. Consequently, this would undermine the functions of judicial operators and increase the power of the criminal legislator, which is not in line with the principles of a democratic state.

The jurisprudence oh the Constitutional Court (TC) on electoral matter was studied in this research in order to determine the fundamentals to annul the resolutions of the National Jury of Elections (JNE) – despite this electoral entity is autonomous and independent – in accordance with the Political Constitution. Methods of analysis, synthesis, hermeneutics and comparison were applied for the study of legislation, doctrine and jurisprudence on the roles of the TC and JNE. In 2006, Peru witnessed a significant event in its political history with the direct election of its representatives to the Andean Parliament. However, the author points out that this historic event may have been overshadowed by the general lack of knowledge on the subject and by the crisis that the Andean Community is facing. In this sense, this article offers a detailed analysis of the Andean Parliament, covering its historical evolution from its antecedents to its creation, its influence within the Andean Integration System, the description of its functions, as well as its composition and structure.

Although the municipal level is the most well-known local level in Mexico, the delegations and mayoralties are other minor administrative units that assist the municipalities in the provision of public services. These smaller units are headed by mayors, delegates or subdelegates, elected by direct vote of the residents and, however, the process that leads them to public office is scarcely known, as well as the conditions in which they fulfill their functions. This article explores the case of three mayors' offices in the municipality of Othón P. Blanco, Quintana Roo and argues that at the subnational level there is an underlying democratic deficit expressed in the electoral process, the functions performed by representatives to promote human development.
