This paper presents the problems regarding the application of articles 56 and 57 of the Political Constitution of Peru, referring to cases in which a treaty requires or not to be approved by the Congress before the President express the consent of the State to be bound by it. Raised the problem, this paper analyzes each case in which the Constitution requires the Congress approval, considering the doctrine, the Peruvian practice on the matter, as well as the rules in force and normative proposals.

In the handling of the contentious proceedings before the International Court of Justice (ICJ) initiated by Bolivia against Chile, regarding the obligation to negotiate access to the Pacific Ocean, the latter State lodged a preliminary objection concerning the ICJ’s jurisdiction. The paper makes a brief analysis of the preliminary objections’ regulation in the Rules of the ICJ, summarizes the Chilean arguments that supported their objection to the ICJ’s jurisdiction, shows Bolivian counterarguments and presents both the arguments and the final decision of the ICJ. The document ends with the author’s comments on the position of the parties and the judgment of the ICJ.

In 2018, article 52 of the Political Constitution of Peru of 1993, which regulates the ways in which Peruvian nationality is acquired and granted, was modified. With this amendment, will be considered Peruvians «by birth», among other cases, not only those persons born abroad of a Peruvian father or mother who are registered during their minority in the corresponding registry, but also those who, in that condition, are registered during their age of majority.This paper explains what should be understood by nationality; develops the Peruvian constitutional regulation of nationality, detailing the amendment process of article 52 of the Constitution; to finally make a critical analysis of this reform.The purpose of this paper is to demonstrate that there is no justification for establishing differences between persons born abroad of a Peruvian father ormother who are registered during the...

This article is about the importance of the education in values in the field of law. He indicates that the values are considered as behaviors, ideas or situations positively appreciated by the human being. Having in mind that whom values is the human being the values are changing, no static. Likewise, we value the elements that are related with our living, with material or immaterial aspects related with our life. We value everything that surround us, the intersubjective relations that form the lifestyle of a human being; also, we value the same relations. In 2006, Peru witnessed a significant event in its political history with the direct election of its representatives to the Andean Parliament. However, the author points out that this historic event may have been overshadowed by the general lack of knowledge on the subject and by the crisis that the Andean Community is facing. In this sense, this article offers a detailed analysis of the Andean Parliament, covering its historical evolution from its antecedents to its creation, its influence within the Andean Integration System, the description of its functions, as well as its composition and structure.
