The national states, self-styled democratic, were formed guided by new principles. The current juridical-political crisis in the western world, especially in Europe, America and in our Peru, reflects the lack of recognition of human rights as the essence of this new society. The purpose of the study was to establish that human rights are the juridical-political foundation of the State as a whole. In this context it is analyzed: The Rule of Law. Its crisis generates a crisis of the principle of legality, as a paradigm of the old State. Constitutional Democracy. It has generated new paradigms and new principles contained in the current Constitution. The Constitution in the face of the Crisis of the Rule of Law has given way to a Constitutional Democratic State to establish new paradigms and principles such as fundamental rights such as human rights and develop fundamental rights as essenti...

The purpose of this article is to explain the influence of emerging scientific paradigms on the teaching of geography in everyday school work. Currently, given the complex environmental reality, the educational work of school geography should be developed with a human and social sense. Therefore, there is an interest in updating the educational processes of positivist pedagogical practice, as it transmits neutral geographic content without practical application. In this regard, the use of the epistemic foundations of constructivism and critical theory is recommended, as they enable the elaboration of knowledge through research. This situation led to the completion of a bibliographic review, whose references facilitated the analysis of the historical situation, positive science in the teaching of geography, and qualitative research in geographic teaching. In these reflections, positivism ...

The purpose of this article is to reflect on the Muiskanoba pedagogical innovation experience, which has education and living as its axes, in relation to the production category of the social space. The implemented methodology is, mainly, the qualitative paradigm. We take as a reference the AI, researchlearning (Panqueba & Huérfano, 2006), which is based on the recognition of the students as main actors in the pedagogical process and of the teachers as knowledges who guide and co-apprehend the teaching process -learning. This experience has been developed in the school “Bachillerato Técnico Comercial Santa Ana” during the years 2019 and 2020, although it is necessary that the educational proposal has been implemented in the institution since 2002. A main aspect that we want to put into dialogue is the construction of ancestral territorial identity in the municipality: we demons...

Bunge (1997) argues that a good scientific explanation should detail the mechanisms that lead from causes to effects. In recent decades, this type of explanation has been incorporated into the dominant paradigms in sociology and political science, where it has achieved both theoretical and methodological advances, above all through the process tracing technique. In contrast, in communication there continues to be an almost exclusive dominance of theories and research using interpretive or variance methods. This paper argues that advances in the mechanism paradigm in other disciplines can be exploited by researchers in the field of communication who wish to study both classical issues in the discipline and social processes in which communication is involved as a relevant causal factor. The main definitions of the paradigm and the most important recommendations of the process tracing metho...

The criminal process is built upon the Constitution. Its legal regulation is not independent but arises inevitably from the fundamental norm of the State. It is precisely within this instrument that the general framework of principles is established, from which the specific rules governing the criminal process in a nation are derived. This theoretical core is referred to in Hispanic-American doctrine as the Procedural Criminal Program of the Constitution, and in Portuguese doctrine as the Procedural Criminal Constitution. It emerged in the 1980s, coinciding with the paradigm shift brought by the Spanish Constitution of 1978, and was later debated in Peru with the 1993 Constitution. In this context, it is logical that there are no research studies aimed at analyzing the historical procedural criminal program in national constitutions. Thus, this manuscript seeks to explore part of the pro...

This article exposes and argues the learning theory called connectivism; a new learning paradigm that is beginning to be applied in this digital era, based on the interconnection of the nodes of a wide network of information and knowledge. The paper mentions some theories that gave rise to this new type of learning, as well as the foundations of this theory by its creators and advocates. The role of the teacher in this new form of learning and the importance of the student or participant node are explained; also, how this theory could evolve by implementing artificial intelligence and how intelligent connections could be achieved. Finally, the theory is projected to a new form of learning based on artificial education, resorting to intelligent nodes and conjecturing, in a certain way, the rupture of the indispensability of the teacher in this learning process.

The architecture of cities currently faces a process of globalization with patterns that are changing urban, social, economic, and cultural structures towards the paradigm of complexity with dynamics in constant interaction, resulting for urban studies an intricate and difficult to understand set. This change requires a systemic vision to recognize both the properties of the object and the behavior of the subjects, around an architectural system, which together add up to more than the whole. Reflection from the academy is important, assuming an interdisciplinary teaching and with an epistemological vision from the global south.

The general intellectual abilities constitute the premises for the formation of professional abilities and competences; however, there are shortcomings in its implementation since basic education. This study was carried out with the objective of characterizing the development process of these skills in the students of the basic schools of Machala. The methodological strategy responded to the quantitative-qualitative paradigm, systematized through the methods of scientific observation, phenomenological, hermeneutic and statistical; the information collected through the application of the observation guide to 12 classes and the interview with 40 randomly selected teachers were summarized through tables and statistical figures. The findings allowed concluding that there are limitations in the intentionality of the development of general intellectual abilities.

Objective: This study aims to describe the relationship between personality and propositional reasoning regarding compound negations by using, in particular, De Morgan’s laws. Method: To evaluate personality traits, we used the Adjective Checklist for Personality Assessment, an instrument based on the Big Five theory and developed for the Argentine context. To assess reasoning, we used a task implemented in previous studies, according to which subjects had to find the logical equivalent of a compound negation. Four response options were offered: one was correct and the other three were linked to specific biases. Both the research study and the paradigm were developed on the basis of the Mental Models Theory of Negation. The study had a correlational design and included 150 university students. Results: We found that factors such as neuroticism, extraversion, and agreeableness were link...

This article focuses on the process of the scenic composition of the project Antiperformance: Palimpsest through the ch'ixi as a performative methodology. The ch'ixi refers to the power in permanent contradiction (Rivera, 2018) confronting the dichotomous and static worldview of the colonial western tradition. For this reason, Rivera Cusicanqui proposes the ch'ixi gaze as an approach that invites the colonized subject to assume the multiple contradictions he/she inhabits. In relation to this anticolonial approach, a methodology is proposed in the performing arts to approach an anticolonial performance, as a praxis focused on corporealities that alter their colonized gaze. For this, the taypi or “ch'ixi space” (Rivera Cusicanqui, 2023) is recognized as indispensable to understand what happens during the contact of perpetual contradictions that detonate the critical energy necessary fo...

Significant advances in computing, telecommunications, and the internet have driven social, economic, and political progress, leading to a paradigm shift: from common crime to cybercrime. Cybercriminal activity has expanded globally, giving rise to new forms of illicit conduct and criminal activity online. This phenomenon has spread worldwide, resulting in punishable actions in cyberspace, committed through social networks, digital media, online environments, and mobile or technological devices. Consequently, legislators have had to restructure and adopt regulatory tools to prevent such crimes. Cyberspace lacks borders and legal regulations, which gives cybercriminals an advantage due to high complexity, anonymity, lack of evidence, and procedural legislation regarding electronic evidence. Currently, the role of the Public Prosecutor faces numerous challenges in the justice system, makin...
