The complexity of construction disputes commands special attention and constant innovation. Fortunately, arbitration is well-equipped to meet the challenges of such disputes, due to its flexibility and adaptability. This paper discusses three areas of innovation in evidence procedure unique to construction disputes: institutional, technological and procedural. Due consideration is also given to the virtual hearing, an innovation which has proven critical to the survival of arbitration amidst the COVID-19 pandemic. Technology, while valuable, will not improve the efficiency of arbitration alone: it must be used in conjunction with procedural innovations. The implementation of procedural, technological and institutional advancements by a proactive tribunal and open-minded parties can create boundless innovation and provide maximum value for all involved.

The following article offers a point of view about the arbitraje as an alternate resolution method for workplace conflicts, in this way, a more critical point of view can be developed about the possibility of the arbitraje usage regulated in the “Ley Procesal del Trabajo” which once again has been regulated in the “Nueva Ley Procesal del Trabajo”. For that purpose, the author analyzes the different points of view existing in the doctrine as well as the ones in the jurisprudence about the labour arbitration situation in the “Ley General de Arbitraje”, followed by this, it will be analyzed the regulation contained in the “Nueva Ley Procesal del Trabajo”.

The facultative arbitration in labor matters procedures allows either party of   the employment relationship to compel the other to submit their disputes to an arbitral tribunal. One of the application assumptions of the facultative arbitration in labor mattersprocedures when bad faith of a party during the negotiation of the statement is noticed,which should be tested.What happens with the decision of the Arbitral Tribunal which admits the claim and establishes that it has jurisdiction to hear the case? In this article, the author analyzes the procedural effects of this decision, in the light of the doctrine and jurisprudence.

The old contractual models and their remedies are not sufficient to cover the current dynamics, this is the case of related operations that require efficient tools for their solution.In this context, the author develops a series of techniques or mechanisms for the efficient and effective solution of the identified problems, consolidation and suspension. It proposes that these mechanisms respond to the contractual mechanics of the current trade, which involves a series of intricate and related relationships, grouping in a single process the solution of the controversy.Likewise, the advantages and elements required by these mechanisms to operate will be analyzed.

The independence and impartiality of arbitrators are essential pillars for the legitimacy of international arbitration. Within the ICSID framework, challenges to the lack of independence and impartiality of arbitrators are examined through disqualification proposals and annulment proceedings. This article examines the rules and practice of disqualification under the ICSID Convention, both pursuant to the 2006 Arbitration Rules and the version that entered into force in 2022, to illustrate how the mechanism operates under the ICSID Convention and what changes have brought greater clarity and speed to the conduct of the proceedings.

The General Arbitration Law provides for the possibility of applying for pre-arbitration interim measures; however, it does not detail specific provisions regarding the securing of evidence by the jurisdiction prior to the commencement of arbitral proceedings. In this context, it is common that, prior to arbitral proceedings, situations arise in which it is necessary to resort to the jurisdiction to collect and protect evidence. In order to ensure the stability of the future process, it is possible to use procedural facilitators to ensure that the required evidence is available and protected when the arbitration is initiated. El presente trabajo examina la participación de los amicus curiae en los arbitrajes de inversiones y su principal rol que han realizado para la apertura al público y transparencia en los distintos procesos arbitrales seguidos bajo distintas normas arbitrales como NAFTA, CIADI, UNCITRAL, ICC. Las principales instituciones arbitrales en los arbitrajes de inversiones han reconocido su participación, sin embargo, le dan un tratamiento distinto a los documentos presentados por estos. El presente trabajo se enfoca en el nuevo movimiento que existe para armonizar la participación de los Amicus Curiae en los procesos arbitrales de inversiones llevadas a cabo ante las principales instituciones arbitrales.

The figure of international arbitration is briefly defined as a method of conflict resolution in the international level, alternative to the Administration of Justice, emphasizing its neutrality, speed and confidentiality.This article shows the new challenges faced by arbitrators, in terms of choice, length of process and efficiency in decision making. In addition, it proposes nine solutions to improve arbitration performance and abbreviate the process of taking decisions.

In the Peruvian legal system, the parties may conclude procedural agreements that condition the access to challenge of the arbitral award to the constitution of a guarantee. These procedural agreements do not violate legislative or constitutional provisions in force. Additionally, they have an express legislative recognition in the Peruvian Arbitration rules. However, procedural agreements have specific limits which, if violated, generate the nullity of said agreements.In this article, the author assesses whether individuals can establish an agreement that makes access to the setting aside of the arbitral award conditional on the provision of security. In this regard he presents, in a critical manner, the main positions that have been raised for and against towards this area in order to demonstrate his initial hypothesis.

The Prague Rules are intended to provide efficiency and reduce costs in conducting arbitration proceedings. The Rules are based on the position that the practice and procedure of international arbitration is too heavily influenced by the adversarial system found in common law jurisdictions, and that the inquisitorial judicial practices of civil law jurisdictions are more conducive to a “streamlined procedure”. In this paper, the authors first consider whether this predicate is accurate and fair. The virtues of arbitration depend on the principle of judicial non-interference in its proceedings and on a limited regime of subsequent judicial control of arbitrations. However, there is a lot of confusion about the articulation of the different procedural control channels applicable to arbitrations, the timing of their activation and their scope. Article 3 of the Arbitration Act establishes the principle of judicial non-interference, but it needs to be understood within the entire framework of existing procedural defenses. For these purposes, the history of national and comparative jurisprudence plays an extremely relevant role.

En el presente informe, criticaremos la decisión del tribunal arbitral emitida a través del laudo a nivel sustancial y procesal, en ese sentido, se analizan las obligaciones contractuales del Contratista según la Ley de Contrataciones del Estado D.L. N°1017, su Reglamento, y el Contrato N°010-2012-MIDIS-PRONAA sobre “Adquisición de Papilla”. Efectuando especial mención respecto a la figura de vicios ocultos en las contrataciones de bienes, en este caso, bienes perecibles y cuestionaremos la lógica del tribunal al considerar cumplidas las obligaciones del Contratista. En el aspecto procesal, observamos una violación al debido proceso, ya que el Laudo fue emitido por dos árbitros recusados mientras el proceso debía estar suspendido según la normativa vigente, lo que constituye una infracción a los procedimientos legales establecidos. This article seeks to demonstrate the thesis that ex officio evidence in arbitration is unnecessary and should be eliminated from it or its application reduced to the minimum possible. For this, the author provides an approximation of the concept of ex officio proof and describes, through the relevant regulations, its use in arbitration. Finally, it analyzes the admissibility of the same, stating that it must opt for a limited admissibility for certain cases, and that it respects the procedural guarantees of the parties.

In this scenario, blockchain technology, has successfully positioned itself in the digital and legal world, mainly due to its ability to create an ideal ecosystem for the execution of smart contracts, as well as its usefulness in developing accessible arbitration procedures, especially in small claims disputes.This article provides an overview of blockchain which, although still in its embryonic stage, has demonstrated significant advances in relation to smart contracts and dispute resolution mechanisms. It also outlines the particular qualities of this technology which, when applied in arbitration, represent multiple benefits as opposed to conventional arbitration.
