The peruvian Supreme Court has considered at the V Labour Plenary that the remunerations left to be received in cases of uncaused or fraudulent dismissal have a compensatory nature. This interpretation has led the notion of punitive damages to be used rhetorically and has provoced that differentiated rules are established without justification in relation to void dismissal.The article explains the reasons why the Supreme Court assumed such position and criticizes those reasons. Finally, a possible solution is presented so that the magistrates do not apply the refered interpretarion in specific cases.

In the Peruvian legal system, the parties may conclude procedural agreements that condition the access to challenge of the arbitral award to the constitution of a guarantee. These procedural agreements do not violate legislative or constitutional provisions in force. Additionally, they have an express legislative recognition in the Peruvian Arbitration rules. However, procedural agreements have specific limits which, if violated, generate the nullity of said agreements.In this article, the author assesses whether individuals can establish an agreement that makes access to the setting aside of the arbitral award conditional on the provision of security. In this regard he presents, in a critical manner, the main positions that have been raised for and against towards this area in order to demonstrate his initial hypothesis.

This document analyzes the conceptual contents of the Private Law Institutions course in the New Study Plan of the Faculty of Law of the Pontificia Universidad Católica del Perú. Two problems are addressed. Firstly, the possible overlaps with the conceptual contents of other courses of the New Plan such as Legal Science Introduction or Fundamental Rights and Constitutional Interpretation. Secondly, the set of topics that are not developed despite being part of the thematic units of the course. Finally, recommendations are made to deal with the aforementioned problems.

Through this article, the author makes an analysis regarding the reform bill of the Civil Procedure Code of Peru in relation to changes in civil liability for the action of precautionary measures regulated in the current code, within the framework of the transition to a new conception of provisional protection, of greater scope than the precautionary protection. To this end, the article presents the conceptual change introduced in the project, the most common cases of civil liability and the obligations of compensation for damages. It concludes with some normative proposals in this regard.

El presente documento analiza los contenidos conceptuales del curso Instituciones de Derecho Privado en el Nuevo Plan de Estudios de la Facultad de Derecho de la Pontificia Universidad Católica del Perú. Se abordan dos problemas. En primer lugar, las posibles superposiciones con los contenidos conceptuales de otros cursos del Nuevo Plan, tales como Introducción a las Ciencias Jurídicas o Derechos Fundamentales e Interpretación Constitucional. En segundo lugar, el conjunto de temas que no se desarrollan a pesar de formar parte de las unidades temáticas del curso. Finalmente, se formulan recomendaciones para afrontar los problemas mencionados.

Mediante el presente artículo, el autor realiza un análisis respecto del proyecto de reforma del Código Procesal Civil del Perú con relación a los cambios en la responsabilidad civil por la actuación de medidas cautelares reguladas en el actual código, ello dentro del marco del tránsito a una nueva concepción de tutela provisional, de mayores alcances que la tutela cautelar. Con este fin, el artículo presenta el cambio conceptual introducido en el proyecto, los supuestos más comunes de responsabilidad civil en estos casos y las obligaciones de indemnización por daños y perjuicios. Se concluye con algunas propuestas normativas al respecto.

El autor busca poner al descubierto una costumbre generalizada como la de agregar el criterio de antijuridicidad en el juicio de resarcibilidad, mediante un análisis comparativo de los sistemas civiles que inspiraron la normativa peruana, el autor demuestra la no esencialidad de la antijuridicidad, que busca generar una ampliación del campo de acciónde la responsabilidad civil.
