On December 21st 2016 the Legislative Decree No. 1272, a regulation that modified various provisions of the General Administrative Procedure Act, Law No. 27444 (LPAG), was published. One of them consisted in the modification of subsection 2 of Article II of the Preliminary Title, which had as a consequence that the conditions established in the LPAG were no longer supplementary, but mandatory. In particular, when a special rule establishes less favorable conditions for the administered. In the last couple of years, the National Institute for the Defense of Competition and the Protection of Intellectual Property has focused its efforts on the persecution and sanction of horizontal practices, initiating a substantial step in favor of improving free market competition.This paper analyses the reasons why public bid riggings are considered per se illegal conducts by our national legislation, as well as how the National Institute for the Defense of Competition and the Protection of Intellectual Property has prosecuted and sanctioned these practices. The authors consider that classifying bid riggings as per se illegal is a consequence of their social impact, since there aren’t any economic reasonsthat differentiate them from other per se illegal conducts.

Brasil, Argentina, Colombia y Perú optaron por la liberalización como solución a sus respectivas crisis energéticas. Todas recurrieron a herramientas comunes (liberalización, desintegración vertical, privatizaciones, eliminación de monopolios estatales, creación de infraestructura administrativa). Brasil, Argentina y Perú consideraron que la liberalización, por sí sola, sería suficiente para atraer la inversión privada. The virtues of arbitration depend on the principle of judicial non-interference in its proceedings and on a limited regime of subsequent judicial control of arbitrations. However, there is a lot of confusion about the articulation of the different procedural control channels applicable to arbitrations, the timing of their activation and their scope. Article 3 of the Arbitration Act establishes the principle of judicial non-interference, but it needs to be understood within the entire framework of existing procedural defenses. For these purposes, the history of national and comparative jurisprudence plays an extremely relevant role.

Las virtudes del arbitraje dependen del principio de no interferencia judicial en su trámite y de un régimen limitado de control judicial posterior de los arbitrajes. Sin embargo, existe mucha confusión y complejidad en la articulación de las distintas vías procesales de control aplicables a los arbitrajes, la oportunidad de su activación y sus alcances. El artículo 3 de la Ley de Arbitraje consagra el principio de no interferencia judicial, pero necesita ser comprendido dentro de todo el entramado de defensas procesales existentes. Para esos propósitos, la historia de la jurisprudencia nacional y comparada juega un papel sumamente relevante.
