This article seeks to analyze the function of the International Criminal Court (ICC) from the analytical horizon of critical studies and the particular contributions of the Helsinki School and social idealism. To achieve this objective, the main postulates of both perspectives are compared towards the concept of international criminal justice (ICJ), in general, and towards the performance of the ICC in its time of validity, in particular. The methodology used is that of a documentary analysis with a strong inclination towards texts of a theoretical, doctrinal and jurisprudential nature.

This paper addresses a particular scenario of the classic tension between constitutionalism and democracy, one that poses the existence of material limits to the power of constitutional reform. The subject undoubtedly raises a series of perplexities around some aspects such as the legal nature of the constitutional reform power. The essay analizes the defense of implicit material limits when the constitutional text has not explicitly recognized them, the competence and legitimacy of the courts, the normative parameter in merit to which this control would be carried out, among others. The essay addresses the restitutions derived from the resolution for non-compliance in a comparative way within the “legal Latinity”. It compares the solutions accepted in Italian law (European legal latinity), and those of two Latin American legal systems, Colombia, and Peru. From the point of view of the discipline dedicated to resolution (termination) and its consequences, the Italian and Peruvian codes are the most advanced, while the Colombian one, which dates from the nineteenth century, leaves ample room for the jurisprudential development of this remedy. This article is the first chapter of the second edition of “The Anatomy of Corporate Law: A Comparative and Functional Approach”, by Reinier Kraakman, John Armour, Paul Davies, Luca Enriques, Henry Hansmann, Gerard Hertig, Klaus Hopt, HidekiKanda and Edward Rock (Oxford University Press, 2009). The book as a whole provides a functional analysis of Corporate (or Company) Law in Europe, the U.S., and Japan. Its organization reflects the structure of Corporate Law throughout all jurisdictions, while individual capitals explore the diversity of jurisdictionalapproaches to the common issues of Corporate Law. In its second edition, the book has been significantly revised and expanded.

This article presents a reflection on the future of the penal clause, its functions, its usefulness and its validity. With the help of descriptive, hermeneutic-legal and comparative methods, we carry out a review of national and foreign regulations, about the intangibility of the contract, the moderating power of the judges and the legislative intervention in the reduction of the penal clause, as a measure temporary as a result of the health crisis.

This article provides a detailed analysis of the legislative structure in Peru, highlighting its concepts, principles, and interrelations. To this end, the author organizes the topic into three theoretical elements: 1) the formal sources of law, 2) the peculiarities of sources of law in Comparative Law, and 3) the functions of the State, the theory of the separation of powers and its consequences. In this line, the author first defines the formal source of law as a procedure that produces binding legal norms and addresses legislation as one of them, emphasizing its role in creating general norms. Our work deals with the flux identication problem for scalar conservation laws. The problem is formulated as an optimization problem, where the objective function compares the solution of thedirect problem with observed proles at a fixed time. A finite volume scheme solves the direct problem and a continuous genetic algorithm solves the inverse problem. The numerical method is tested with synthetic experimental data. Simulation parameters are recovered approximately. The tested heuristic optimization technique turns out to be more robust than classical optimization techniques.

In the present article the evolution of property is exposed. Previously, the essence of property was constituted by the right of enjoyment, disposition and organization of social work. Now, the property covers various aspects such as the relationship between the shareholder and its action, the right of the owner of rental houses, the relationship between the company and its asset assets. This article undertakes a comparative study of the ius aedificandi in Peru, with the aim of defining its scope and exploring possible improvements. For this purpose, three references were considered: Spain, Brazil and Colombia, countries in which the ius aedificandi does not integrate —at least, automatically— the property right (of the land). In Peru, by contrary, the civil law conception of this right remains in force, whereby the right to build constitutes one of the faculties inherent to property ownership. The comparison between these models reveals the first signs of change in Peru and underscores the need to consolidate such developments.
