This article undertakes a comparative study of the ius aedificandi in Peru, with the aim of defining its scope and exploring possible improvements. For this purpose, three references were considered: Spain, Brazil and Colombia, countries in which the ius aedificandi does not integrate —at least, automatically— the property right (of the land). In Peru, by contrary, the civil law conception of this right remains in force, whereby the right to build constitutes one of the faculties inherent to property ownership. The comparison between these models reveals the first signs of change in Peru and underscores the need to consolidate such developments.
