The author analyzes the land tenure and size of the territory and the different perspectives of understanding the property, starting with the western angle of private property, with the individualistic nuance, through public ownership with its nuance of State resources, and finally by the idea of communal property with the collectivist hue, whose ownership lies not with the individual, or the state, but on a group previously identified as culturally consolidated.

In this article, the author proposes to expand the concept of property that is currently held under Constitutional law in Peru. Specifically, he proposes to protect the right of possession that communities hold over informal housing as part of the constitutional right to property. This right of possession, as the author states, consists of factual control over the asset and the recognition of this control by the community to which the individual belongs. The article confronts two apparently contradictory realities. On the one hand, almost 50% of the houses in Peru have a legal property title. On the other hand, the jurisprudence of the Constitutional Court has repeatedly indicated that the right of possession is not part of the constitutionally protected content of the right to property. In other words, almost half of&n...

From the official announcement of the next generation of social property of means of production, there have been several attempts to define the objectives, characteristics, the scope and other aspects of vital importance for its implementation and development. The University of Pacífico, specially its Management Department, did not want to stay out of this enriching debate. For this purpose, it assembled in last November a roundtable to clarify two important aspects: the immediate antecedents and the mechanisms of implantation of social property in Peru.

In Roman Law, the classification of property into movable and immovable has responded to a criterion of mobility corresponding to the nature and physical characteristics of things. On the other hand, in the old French Law, the classification criterion was mainly based on an economic criterion, in which the value, the duration and the possibility of the goods to produce income periodically predominated. With the implementation of the French Civil Code (1804), the division between movable and immovable property acquired universality, being repeated in almost all Western legislations. However, in this paper we recognize that this classification has certain shortcomings, especially because it doesn’t meet all current requirements. Thus, its ineffectiveness is criticized, as well as the ineffectiveness of Peruvian legislation because it’s based on it. In this line, it’s proposed to repl...

Muscle proteins of Dosidicus gigas mantle have great techno-functional advantages and during their processing at industrial level considerable discards of muscle proteins are generated and used to elaborate meals with low added value. The aim of the study was to evaluate the effect of hydrolysis time on the techno-functional properties and antioxidant capacity of jumbo squid. Mantle muscle protein discards were cooked, ground and subjected to enzymatic hydrolysis (Protamex ©) for 1, 2, 3, 4, 5 and 6 hours at 58 ° C; ratio of water: substrate 1: 1. The hydrolysis reaction was stopped at 90 ° C for 5 minutes and then were filtrate. Hydrolyzed solutions (2% of dissolved solids) in established times were taken and their techno-functional properties such as foaming, emulsifying, antioxidant capacity and degree of hydrolysis were determined. The hydrolysis reaction was stopped at 90 °C for...

Developing countries have been, in most cases, sceptical about the implementation of intellectual property protection (IPP) with the premise that this policy will hurt the coverage of medicines because the price of the drugs will be substantially high. This claim has overlooked the long run effect of IPP and has dismissed the other relevant policies to tackle the low drug coverage in poor countries. In this paper we measure the impact of IPP on Antiretroviral drugs coverage in 59 countries. According to our estimates, an increase in one unit in the IPP, measured by Park-Guinarte index, leads to an increase of 6% in antiretrovirals prices. However, the overall impact of IPP on coverage is positive; in fact, the marginal impact of a unit of increase in IPP on coverage is almost 14%. This is, most likely, due to the proper incentive framework provided by the IPP to create more and better d...

This paper addresses the changes in property rights over real estate associated with the agrarian reform. The author analyzes the mechanisms of acquisition, conservation and loss of property: direct conveyance, acquisitive prescription, abandonment and antisocial use. It also analyzes the measures contemplated in the legislation to avoid property fraud, as well as the interpretation of the right to possession, use, enjoyment, claim and disposition in accordance with the agrarian reform regulations, which differentiates it from the classic regulation of the Civil Code. In this way, the author emphasizes that the agrarian reform legislation privileges the social interest over the individual interest and links the right to property to the direct work of the land.

Background: Antisocial behavior refers to a set of acts that violate the rules established for the coexistence of society. One of the self-report measures to assess this type of behavior is the normative deviance scale (NDS). Objective: Considering that in the Argentine context no studies on the psychometric properties of the scale were found, the present study aimed to analyze the psychometric properties of the scale in a sample of Argentine youths. Method: To this end, a sample of 794 participants aged between 18 and 25 years was collected. A confirmatory factor analysis was performed; the composite reliability was calculated; and the convergent, discriminant and concurrent validity was assessed (using a self-control scale). In addition, the invariance of the factorial structure of the scale was analyzed. Results: The results confirmed the original factorial structure of the scale with...

The purpose of this work is concrete: starting from an outline of the traditional property system of our country, it looks for its sediment in the legal institution of property to contrast it with the official references to the new economic sector formed by enterprises of social property which will be established soon. This with the aim of finding the notes that is possible to attribute it and those that must be discarded.

This article addresses the right to identity from a perspective linked to the right to property. The author argues that, at present, poor majorities do not have access to property, and are therefore excluded from effective legal protection of the right to property, and that this problem, in turn, prevents the right to identity of these majorities from being guaranteed. In this context, this contribution seeks to show how the right to property represents a crucial - and determining - factor for the effective safeguarding of the right to identity of persons. In this way, this paper focuses on a more inclusive perspective of the right to identity, extending its projection to the field of property rights and, above all, highlighting its relevance for the most vulnerable communities.

This original article brief, gives release preliminary results of a study conducted in the year 2014 on the loss of the good obligation from crime or misdemeanor and the restitution of property governed by Peruvian law, therefore it aims to establish the interpretive meaning of Article 1140 of the Civil Code of Peru established that the debtor (author of the crime or offense) is required to pay the value of a good, arising from the commission of the offense or lack the creditor (third party purchaser in good faith), by the legal impossibility to deliver a well that was returned to its rightful owner. This course does not apply when the debtor (the offender) has been in arrears to creditor (third party purchaser in good faith). To reach this result, he came to the knowledge of contract law and criminal law, which allowed us to contextualize the interpretive problem. The investigation empl...

The Supreme Court of the Republic of Peru, has established as a criterion in its agreements and appeals, that in claim demands, when the parties claim property rights, they should no longer be declared inadmissible under the argument that they must previously determine who has the best property right, but right there, must be resolved as a controversial point. Now, when the best property right is determined as a controversial point to resolve the claim, it has been substantiated as if it were a purport, the parties exercising the guarantees that due process contains, including the audi alteram partem and the right to the test, to assert its property right and / or to question the other, but as it was not requested, a ruling on the merits can not be issued, this in merit to the principle by which only the parties can incorporate the or the petitions, having to do so in a clear and concret...

The effects of concentration and temperature on the thermo-physical properties of apple juice were studied, in which density and viscosity were measured at different temperature and concentration conditions, varying from 20°C to 80°C and from 12 to 70° Brix, respectively. Density was determined by the pycnometer method and viscosity by Hooke's falling sphere method, based on Stokes' law. The density results were correlated several times, arriving, by the least squares method, at a multiple linear regression model, of three terms; while the viscosity results proved to be more difficult to correlate, which, by the least squares method, arrived at a multiple linear regression model, of six terms. The experimental mathematical models can be used to obtain the density and viscosity data within the temperature and concentration conditions indicated in the study. Key words: density –...
