El presente trabajo analiza los alcances del derecho a la identidad, la importancia de abordarlo desde una visión moderna, dinámica y comprensiva y la necesidad de introducir mecanismos institucionales efectivos para tutelar sus esferas estática y dinámica; la primera de las cuales se refiere al registro e identificación de una persona y la segunda se extiende a la “verdad personal o proyecto de vida” de cada sujeto. También se identifican los principales obstáculos para acreditar la existencia legal de las personas y reconocer los derechos sobre sus tierras y viviendas - que a nivel mundial representan hasta un 90% del patrimonio familiar; y se pone en evidencia cómo la informalidad y la exclusión del Estado de Derecho no sólo impiden tutelar el derecho a la identidad en su dimensión más amplia, sino consolidar temas de relevancia nacional como la gobernabilidad, institu...

This article addresses the right to identity from a perspective linked to the right to property. The author argues that, at present, poor majorities do not have access to property, and are therefore excluded from effective legal protection of the right to property, and that this problem, in turn, prevents the right to identity of these majorities from being guaranteed. In this context, this contribution seeks to show how the right to property represents a crucial - and determining - factor for the effective safeguarding of the right to identity of persons. In this way, this paper focuses on a more inclusive perspective of the right to identity, extending its projection to the field of property rights and, above all, highlighting its relevance for the most vulnerable communities.

El presente artículo busca introducir a los lectores en el tema del derecho a la identidad bajo una aproximación distinta, esto es, desde una óptica más comprensiva que lo extiende al ámbito de los derechos de propiedad. Se pretende demostrar cómo el acceso a la propiedad por parte de las mayorías pobres, hoy excluidas del amparo de la ley y de los beneficios que esta brinda, constituye un presupuesto indispensable para garantizar el derecho a la identidad en su dimensión más amplia.

The growing number of “international” marriages, with nationalities, domiciles and properties that link the spouses with various countries, and that generate patrimonial relations both between the spouses and with third parties, highlights the importance of the issue related to the patrimonial economic regime of such marriages. The paper addresses the autonomy of will in the Peruvian Civil Code of 1984, focusing on articles 2095 and 2096. These allow the parties to freely choose the law applicable to a contract, without requiring a direct relationship between the selected law and the contract, which could lead to abuses such as the “internationalization” of contracts that are purely national. In this regard, the authors indicate that the intention of the parties to choose a certain law is due to their interest in achieving the application of a more permissive, or less prohibitive, law. They point out that the main problem lies in the fact that the Code does not contemplate the limitation of an “internationally permissible connection”.
