This article provides a different approach to the debated issue of the criterion of solution of what has come to be called “property not registered vs. embargo registered”. In it, it argues that all the solutions that has been raised (even the adopted as “binding precedent” in the judgment of the Seventh Civil CassationPlenary) are based on an optical error, because they look at the embargo act of a static way, as if it were an act that creates a final situation, forgetting that the embargo is a procedural act that is not an end in itself, but is inserted into the dynamic of the execution process, a process in which the final situation occurs (the awarding of the asset under seizure to the successful bidder or creditor, that is, the acquisition of a real right). Observed, however, theembargo on the dynamic of the executive procedure, as an act that prepares the forced alienation ...

The cognition or declaratory process is currently the only mechanism that allows a creditor to claim recognition of its right, but it has significant disadvantages, such as its lengthy duration of 5 to 10 years and the high costs associated with it, even for small debts. To solve this problem, the order for payment process has been implemented in several jurisdictions, which offers a more agile procedure in which a judge can quickly recognize the creditor's right and issue an enforceable order. This process can be pure, without the need for documentary evidence, or documentary, which requires some evidence to support the claimed obligation. In case of opposition by the debtor, this must be substantiated, which may result in a declaratory proceeding to clarify the existence of the claim. The Commission for the Reform of the Code of Civil Procedure proposes two types of order for payment p...

Intelligence is a construct of notable impact in our sociocultural context, related to a wide range of conceptual and operational definitions which originate positions that highlights cognitive and abstract elements and emotional and social skills, as well was perspectives that are focused on processes underlying the intelligent performance, such as in the case of executive functions (EFs), which are configured as cognitive processes that make it possible the self-regulation (Miyake & Friedman, 2012). Similarly, there are approaches that give intelligence a relevant and predictive role of school performance, an aspect strengthened by the psychometric perspective, where the concept of intelligence has been closely linked to learning. In this line, we also find the classical perspective of crystallized Intelligence of Cattell (1943), which refers to the knowledge acquired through educa...

This article, entitled “The relationship between the Participatory Budget and the Budgetary Execution of the District Municipality of Lurigancho in 2016”, has as a general problem that drives the research of the article, the application of the following question: What is the relationship between the Participatory Budget with the Budgetary Execution of the District Municipality of Lurigancho, during the fiscal year 2016; likewise, the general objective is to determine to what extent the participatory budget is linked to the Budgetary Execution in the district of Lurigancho. The results were the high correlation existing between the participatory budget with the budget execution of the Municipality of Lurigancho, using Spearman’s RHO. The relationship between executive functions (EF), creative personality, and academic performance in Argentine university students was examined. A total of 248 students (M = 22.97 years, SD = 4.43) from various Argentine provinces participated. The Adult Executive Functioning Inventory (ADEXI), the Cognitive Flexibility Scale, the Creative Behavior Scale (ECC), and the Creative Personality Scale (EPC) were used, along with academic performance data and sociodemographic information. Data were collected online through Google Forms and analyzed using Spearman correlations and mediation analysis with robust Maximum Likelihood estimator and Bootstrap. Cognitive flexibility exhibited the most robust correlation with grade point average (r = .281, p < .001), followed by working memory difficulties (r = -.234, p < .001). Creative personality correlated positively with grade point average (...

The uncertainty and high rate of mistrust that exists between teachers and their governing authorities, especially in pedagogical matters, is one of the key problems in teaching-learning. In this study it was verified that the Pedagogical Directive Leadership is related to the Pedagogical Competences of the Teacher at the secondary level of the “Mercedes Cabello de Carbonera” school. Lima 2018., since it is through a p whose value less than 0.05 in the statistical analysis, such a relationship is demonstrated with an r = 0.768, which is a correlation of 76.8%. And it relates the personal competencies of the teacher whose r = 0.593 is a correlation of 59.3%. Competencies from institutional management have an r = 0.543 which is 54.3%. Communication management competencies have a significant relationship whose r = 0.638, which is 63.8%. It is important to take these correlations into ac...

In Mexico, a high percentage of young people experience symptoms of generalized anxiety, which are associated with difficulties in executive functions (EF). However, previous studies have shown inconsistent results, as they often rely solely on either objective or subjective measures. Therefore, this study focused on analyzing the relationship between generalized anxiety and EF using both a neuropsychological battery and a self-report questionnaire, in order to provide a more comprehensive understanding of cognitive functioning in adolescents. A quantitative, non-experimental, cross-sectional, correlational, and explanatory design was employed. The sample consisted of 96 adolescents between 12 and 15 years old from the state of Puebla, Mexico. A total of 10.41% of participants presented severe symptoms of generalized anxiety. A significant relationship was found between anxiety and one o...

The multi-tiered dispute resolution clauses are a very popular type of arbitration agreement nowadays. These clauses provide that, in order to resolve disputes arising out of a contractual relationship, the parties may or should have recourse to more than one dispute resolution mechanism, which will be used progressively, one after the other. Although this type of covenants may present advantages for the parties, they may also become problematic clauses, which, when inadequately designed or managed, may be a source of additional conflicts to those already arising. For this reason, this article will analyze the main problems that arise in connection with this type of agreement. More specifically, three issues are analyzed in relation to the pre-arbitration stages: their enforceability, the most relevant factors to be taken into account for their execution and compliance, and the consequen...

The objective of this research was to deepen the understanding of ethnomathematics developed by masons in the Amazonian regions of Peru. To this end, the mathematical concepts implicit in the masons' practices were identified and analyzed, as well as to understand the role of culture and the natural environment in the configuration of this knowledge. The type of study was considered ethnographic, and consisted of gathering information through observation. A questionnaire was applied, with the purpose of evidencing the procedures carried out by the masons in the resolution of labor calculations using the fundamental operations (addition, subtraction, multiplication and division) of ethnomathematical origin. In the same way, scientific articles were reviewed. One of the key findings of this research is the integration of mathematical concepts in the labor practice of masons. It was observe...

Background: Mechanical reasoning (MR) is the ability to identify the components of a system and understand how they interact in order for the system to work. Different mechanical systems, such as those of wheels and gears, require different types of reasoning. Objective: This study seeks to analyze the relationship that working memory (WM) and processing speed (PS) have with MR. Method: One hundred seventy-three (173) university students were assessed through the DAT test which consisted of 30 MR problems, the symbol search subtest of the WAIS-III battery for assessing the PS, and the BIMET-V and BIMET-VE batteries to evaluate the WM verbal and visuospatial components. Results: Regression analyses showed that the proposed variables do not predict the performance in gear problems, while the visuospatial WM and the PS predict the performance in wheel problems. Discussion: The results sugge...
