A key component of these analysis has been - and continues to be - the need to guarantee the compatibility of national legal systems with International Criminal Law, with the aim of fighting against impunity and to prevent the commission of international crimes. The constantly experienced changes by the international business processes are caused policy changes of the countries, the new technologies or the implementation of corporative business strategies facing logistics operators and fluctuations of economy. For this reason, in the present time it important to study and analyze the costs associated with imports and exports. In 2010, Peru imported 21 billion dollars and exported 13 billion dollars. Then, in 2015 we imported 14 billion dollars and exported 27 billion dollars. This change leads us to propose structures which reflect the costs associated with the processes import and export. One of the most conflictive scenarios for criminal law and its punitive and preventive responses is found at the confluence of armed conflicts, being these an inexhaustible engine of production of regulated criminal acts, both nationally and internationally. The present work will focus its study on those crimes related to internal armed conflicts and on how we can reach a more comprehensive legal logic from a dogmatic criminal perspective derived from the theory of crime —more than a political response in amnesty—, specifically through assumptions of need, when providing a definitive resolution to a context of armed conflict, which requires unrestricted criminal solutions to the dialectical borders of each government in office.

The paper analyzes U.S. jurisdiction, highlighting how courts assume jurisdiction in disputes involving citizens or entities of other countries. In the U.S. system, jurisdiction depends on the State where the dispute occurs, which often requires the intervention of courts in different States or countries. In this regard, the two classic methods of securing jurisdiction are explained: on the one hand, “in personam” jurisdiction, which refers to jurisdiction over persons; on the other, “in rem” jurisdiction, which deals with property within the state; and, as a third and developing basis, “quasi in rem” jurisdiction, used in some exceptional cases, is discussed. This article reviews the processes of consolidation of the principle of legality and of the criminalisation of crimes against humanity in international criminal law from a historical perspective. It starts with the Nuremberg Tribunal of 1945 and then traces the development of these two processes side-by-side: the enshrinement of the principle of legality in a series of universal treaties protecting human rights between the 1960s and the 1980s and the criminalisation of crimes against humanity in the Statutes for the International Criminal Tribunals for the former Yugoslavia and for Rwanda and in the Rome Statute of the International Criminal Court.

The emerging international system in the twenty-first century is characterised by a new phase of globalization in which, largely due to the explosion of information and communication technologies, the role and activity of a variety of actors –outside and within states– has been significantly strengthened. While the states remain as the main actors of the world system, the current configuration of the international order no longer responds to the Westphalian state-centric paradigm that shaped international relations until the end of the twentieth century. In this new scenario, the role of subnational actors is increasingly active, which opens a window of opportunity for developing nations to improve their competitive and cooperative insertion in the international system at both regional and global levels.

The Prague Rules are intended to provide efficiency and reduce costs in conducting arbitration proceedings. The Rules are based on the position that the practice and procedure of international arbitration is too heavily influenced by the adversarial system found in common law jurisdictions, and that the inquisitorial judicial practices of civil law jurisdictions are more conducive to a “streamlined procedure”. In this paper, the authors first consider whether this predicate is accurate and fair. Are adversarial practices the source of inefficiency in international arbitration, or can the reasons be found elsewhere? Next, they compare certain features of the Prague Rules to the IBA Rules on the Taking of Evidence, and examine how both sets of rules differ in substance. The enforceability of awards is the most valued feature of arbitration. This alternative dispute resolution mechanism depends, almost entirely, on the efficiency of the final product it provides: the award. The quality of this instrument, however, may vary depending on the arbitrators in charge of rendering it and, most important, the institutions that fulfill the function of regulating the arbitral procedure.In this article, the authors propose that arbitral institutions in Peru implement the scrutiny of awards in order to improve the quality and enforceability of awards. This contribution analyzes the role fulfilled by International Labor Standards and, specifically, by social clauses in Free Trade Conventions and Agreements, as a way of preventing social dumping and building a social dimension in the globalization and regionalization of economy. The author offers the case of the MERCOSUR Labor and Social Declaration, issued in 2015, which amends that of the year 1998, studying its contents, legal efficacy and supervision mechanisms. He emphasizes the fact that social charters generally limit themselves to recognizing fundamental or basic labor rights already found in the legislation of the member countries, but which are nonetheless useful for hindering attempts to deregulate or relax social and labor provisions.

The Private International Law is related to different legal disciplines; for that reason, one of their important subjects within the frame of the International Procedural Law is the International Judicial Cooperation, which is called international judicial attendance. The practice of procedural acts outside the place of the process with foreign element is common, and that is possible thanks to the will of the States making the territoriality and sovereignty principle of the process not an impediment for the performance of fundamental diligences that allows to explain the controversy.
