The Inter-American Court of Human Rights is aware that judges and domestic courts are subject to rule of law and forced to apply provisions in force in their body of laws. But, when a State has ratified an international treaty such as the American Convention, the judges are forced to observe them. Article 2.3 of the applicable Regulations of the Inter-American Court of Human Rights, partially reformed and renewed, defines the term amicus curiae as «the person strange to the dispute and proceeding who offers the Court ideas about the events contained in a lawsuit or formulates juridical considerations on the matter of the proceeding through a document or pleading in a hearing». Therefore, they have a significant value for the strengthening of the inter-American system for the protection of human rights, through reflections provided by members of the society, which contribute to the deba...

The following paper proposes to give arguments to relativize the extensive account that the concept of alienation lost theoretical attention in the field of philosophy during the eighties of the last century, and that a revival of the study of the concept occurred in the nineties. The conclusion is that there was no such loss of attention, but that furthermore, the presumed premises in the discussion concerning alienation from the nineties up to the present were delineated during the eighties. This conclusion has two supporters: the type of approach regarding alienation carried out by analytical Marxism and the philosophical incursions into the concept in the context of North American sociology. Based on this, the text offers a systematization of the history of the philosophical study of the concept in two sections or stages. And it concerns itself with two –and not three– stages bec...

This article explores emerging social media discourses around a viral video featuring an Andean festive dancer, recorded in an ambiguous situation and widely shared online. Using a mixed methodology—combining manual coding, semantic analysis, and lexical graph visualization—we identify four discursive territories: ethical judgment, performative defense, techno-doubt, and indeterminacy. We examine how artificial intelligence is invoked by users to displace agency, deflect moral responsibility, and renegotiate blame. The study contributes to understanding public emotions, trust in algorithmic systems, and social imaginaries of artificial intelligence in festive and media contexts. It also discusses how cultural heritage becomes a site of symbolic contention when it intersects with virality, technology, and representation.

Essentially, the loss suffered by the global construction industry during the time when the COVID-19 is spread is not caused by that pandemic itself but caused by a changed circumstance which mainly resulted by anti-COVID-19 policy or law conducted by different jurisdictions. Where contract keeps silent in this regard, legal solution should be made by contemplating the law in different jurisdictions toward changed circumstances, which commonly includes situations where performance of contract become more onerous or impossible, and taking account of the factual environment which determines or impacts the changed circumstance. This paper, from a comparative law perspective, discusses and concludes the doctrine of changed circumstance in some typical jurisdictions, and, by taking consideration of law and fact, provides some approaches and potential legal solutions to deal with that loss.

One of the key topics of discussion during and after the pandemic caused by the appearance of covid-19 around the world is the civil liability generated by the actions of health professionals (considering the health structure) before unforeseeable emergency situations. Likewise, the Peruvian health system was forced to face various challenges, through tools such as the application of public policies and implementation of special regulations, which mostly had an impact on the determination of the responsibility of health professionals during the state of health emergency. In this sense, in this research work, civil medical-sanitary liability will be addressed, based on a study of the application of the lex artis according to the national legal system. To do this, it will start with a study of medical-health civil liability in Peru, detailing what types of obligations apply depending on th...

This article studies the parliamentary debate over the approval of a legislative change on the Spanish Civil Code, which gave permission to Same-Sex marriages since 2005. The author tries to approach to Congress debates as complex processes, in which different levels of rationality (as of irrationality) are intersperse in the argumentations of senators and deputies. In order to clarify this confounding scenario, the tools of ‘legisprudential studies’ or legislative rationality are of utmost importance, because they allow us to group the reasons in typologies, and to analyze possible counter-arguments or voids relating to supporting evidence. That is why the approach of this work, in relation to the substance of the matter, is neutral and rather points to demonstrate the immense methodological potential of legislative rationality models, and how these could contribute to...

Approximately 90% of the sixty thousand museums that exist around the world have closed either totally or partially due to Covid-19. In this new era, one of the main challenges that museums face is staying connected with their public. This study seeks to identify evidence of how prepared Lima’s museums are to face new challenges like that presented by Covid-19, and what recommendations they should follow in terms of research, communication and education. Following an exploratory discourse analysis based study, a list of recommendations was compiled and grouped into three categories: management of virtual collections, virtual visits, and the use of social networks as learning spaces. This research shows that those museums which implement strategies related to their research, communication and educational functions, as well as the use of information and communication technologies, will b...

The study of heritage requires new conceptual approaches that contribute to its current theoretical debate, in order to re-nourish the knowledge of different disciplines that address it. In between, richer and more complex crossovers are generated. This article presents the positions of different authors and submits them, especially, to the discussions on rural space, tourism and the logics of land use planning. As axes, work on heritage as a concept, approach, process and attitude is proposed. The conclusions will reveal that it is necessary to expand certain conceptual categories to better cover the heritage of rural areas, as well as a need to rethink tourism in that environment.

Since 2015, the demand and price of lithium have increased considerably due to its central role in battery production. Latin America has around 60% of the world's lithium reserves. The deposits are mainly located in the Puna region shared by Chile, Bolivia, Peru and Argentina. The possibility of extracting lithium from salt flats is promoted by governments and companies as an undeniable opportunity. At the same time, lithium mining is presented as a key to solving the climate crisis, given the need to reduce greenhouse gases and favor the energy transition. In contrast, lithium extraction is considered by local communities as pernicious because the extraction involves the loss of large volumes of water, since lithium is dissolved in the salt flats and a large amount of fresh water is used during the process and because of the chemical contamination it generates. This paper will address t...
