This article addresses the way entry regulation works, creating prohibitions for the access of new competitors to markets (absolute effects) or limitations to the number of providers that can operate in the market (relative effects). The paper also assesses whether Peruvian legal framework allows for entry regulation, because it guarantees free private initiative and prohibits the creation of legal monopolies. Finally, several examples from Peruvian experience are used to explain the scenarios were entry regulation can have suitable and reasonable justification, as well as other scenarios were such measures lack support and cause negative effects on the market and consumer choices.

De esta manera, el autor expone aquellas posiciones que sustentan que la confianza en el actuar profesional de un médico o educador, generada por contacto social, es fuente de responsabilidad contractual o fuente de responsabilidad precontractual. En el presente trabajo se plantea los retos de la integración subregional por parte de algunos Estados de América del Sur, teniendo en cuenta dos fenómenos: los antecedentes dictatoriales en la región son provocados generalmente por golpes de estado militares, sean de sectores conservadores o progresistas y la concentración del poder en el ejecutivo con efectos en el equilibrio de los poderes. Para alcanzar los objetivos de integración regional se da una mirada a UNASUR y sus dificultades en relación con el respeto a la democracia y los derechos humanos; asumidos como pauta de actuar internacional de la región americana.

This paper discusses the problem related to conflicts of interestand its various manifestations, particularly in public administration. in this regard, the author makes an ethical analysis of the concept, and he examines the regulation of conflicts of interest in the administrative field and its configuration as a constitutional limitation of fundamental rights. In this way, the paper concludes that the regulation of conflicts of interest in governance should aim to seek efficiency and balance since the position of a public servant implicates acting according to what is of general interest.

Facing the phenomenon of organized crime, the criminal justice system for legal persons is confronted with the need to adapt the theoretical structures in order to provide an answer to the challenges rising from the high degree complexity and volatility, common qualities of the contemporary societies. t he modern legislations claim different solutions, such as the vicarious liability “act like someone else” or “be in someone else’s place”, which allows transferring the responsibility or guilt of a person. t his, among others, is recognized as a dual justice system. It is believed that a specific justice system for legal persons should be reached and, taking into account its peculiarities, make it coexist with the proper system for physical persons.

The Peruvian Government decided to use Public-Private Partnerships as a tool in its infrastructure policy. However, the constant amendments to the legal framework, the delays in the execution of projects and the frequent addend to concession contracts (specifically, those which are co-financed) have created distrust in society and affected the credibility of this model.This article analyses the main causes foref renegotiation of concession contracts awarded by ProInversión and the derived costs of excessive renegotiation. Our data shows that the benefits that the Peruvian Government obtains by acting opportunistically: i.e., by awarding projects that lack sufficient studies or an adequate risk assignment, are countered by the impact on the legitimacy of Public-Private Partnerships and by the delays in the completion of projects destined to attend public&nbs...

In this paper the author presents the challenges of subregional integration faced by some South American states. They must ponder two phenomena: the dictatorial events in the region are usually caused by military coups led by conservative or progressive forces and the concentration of power in the executive branch disturbing checks and balances. In order to achieve the objectives of regional integration, it is necessary to analyse UNASUR experiences and difficulties regarding democracy and human rights; both are the criteria to assess the international conduct of states in the Americas.

The purpose of this paper is to demonstrate that the Mexican State has regulatory mechanisms for the isolation of potentially dangerous individuals. By this I mean that the measures implemented in terms of prevention and security adopted by the Mexican State in 2008 are permeated by the criminal law of the enemy, whose primary objective is to safeguard the integrity and security of persons in a context characterized internationally by high levels of violence. La prueba de oficio en el proceso civil responde a la necesidad de arribar a la máxima aproximación de certeza de las premisas planteadas por las partes. La aporta el juez cuando este advierte la ausencia de un medio de prueba que es necesario para resolver el conflicto, pero que las partes no han podido impulsar.
