The need for social rights in developing countries is essential for the full development of the population both in different economic, cultural, technological, environmental, social aspects... etc. According to Article 1 of the Constitution of Peru person and his “dignity” are the supreme goal of society and the state, and in the case of social rights where the dignity of the disadvantaged or victims facts warrant random through public policies. One of the problems faced is that there is an ambiguity between the boundary of the private and the public, and this is be: cause many of the functions that promote social rights are services that can be found in the private sector, such as education and security. El Derecho Administrativo tiene una gama de principios reconocidos en su propia ley general. No obstante, el preservar incólumes dichos principios como el de legalidad o tipicidad significa poner en riesgo bienes jurídicos tan importantes como el ambiente, cuyo daño seria irreversible. La norma en blanco se muestra como una alternativa que ha funcionado en otras ramas del derecho sancionador, esto con la finalidad de que la norma se adapte de una forma mas eficaz a la realidad.

El presente artículo, denominado “La aplicación de la caducidad en los procedimientos sancionadores del Tribunal de Contrataciones del Estado”, aborda el uso preciso de la temporalidad y especialidad para garantizar los derechos de seguridad jurídica y predictibilidad de los ciudadanos respecto al resolver del Tribunal de Contrataciones con el Estado. Es una investigación descriptiva y cualitativa se centra en la recopilación de varias fuentes de información sobre la materia de investigación.
