The cognition or declaratory process is currently the only mechanism that allows a creditor to claim recognition of its right, but it has significant disadvantages, such as its lengthy duration of 5 to 10 years and the high costs associated with it, even for small debts. To solve this problem, the order for payment process has been implemented in several jurisdictions, which offers a more agile procedure in which a judge can quickly recognize the creditor's right and issue an enforceable order. This process can be pure, without the need for documentary evidence, or documentary, which requires some evidence to support the claimed obligation. In case of opposition by the debtor, this must be substantiated, which may result in a declaratory proceeding to clarify the existence of the claim. In this essay we analyze the consequences of the new procedural labor Act and its application to the final stage of the judicial process specially. In other words, we analyzed the execution of court’s decision and the settlement agreement of the judicial conciliation, because this legal instrument proves the importance of the effectiveness of the judicial process. Furthermore, this two elements serve to value the resonance of the citizen’s claim and the recognition of their civil rights.

The uncertainty and high rate of mistrust that exists between teachers and their governing authorities, especially in pedagogical matters, is one of the key problems in teaching-learning. In this study it was verified that the Pedagogical Directive Leadership is related to the Pedagogical Competences of the Teacher at the secondary level of the “Mercedes Cabello de Carbonera” school. Lima 2018., since it is through a p whose value less than 0.05 in the statistical analysis, such a relationship is demonstrated with an r = 0.768, which is a correlation of 76.8%. Objective: To determine the incidence of the Affectation process in the use of the properties in the management of the real estate of the State administered by the National Superintendence of State Property, period 2012 - 2016. Method: It is a substantive, explanatory, quantitative, transversal research and a retrospective, correlational and non-experimental one, based on measurement, numerical evaluation and statistical analysis. In recent years, Peru has faced a political crisis marked by continuous clashes between the Executive and Legislative branches, particularly during the 2016-2020 period. These conflicts led to various institutional responses—such as impeachments, dissolutions, and resignations—that, rather than resolving the crisis, contributed to its prolongation. This cycle of instability culminated in a wave of social unrest, expressed through mass protests and the resignation of then-president Manuel Merino. This study argues that the weakness of Peru’s presidential model, reflected in its institutional design and its limited capacity to manage presidential crises, facilitated the persistence of the Executive-Legislative conflict during the 2016-2020 period. This contribution analyzes the role fulfilled by International Labor Standards and, specifically, by social clauses in Free Trade Conventions and Agreements, as a way of preventing social dumping and building a social dimension in the globalization and regionalization of economy. The author offers the case of the MERCOSUR Labor and Social Declaration, issued in 2015, which amends that of the year 1998, studying its contents, legal efficacy and supervision mechanisms. He emphasizes the fact that social charters generally limit themselves to recognizing fundamental or basic labor rights already found in the legislation of the member countries, but which are nonetheless useful for hindering attempts to deregulate or relax social and labor provisions.

So, this research aimed to provide a human resource management model based on knowledge management in executive organizations in Sari, Iran. This research is applied in terms of purpose and its method is survey research. The nature of this study is descriptive with the type of correlation.
