This article seeks to analyze the function of the International Criminal Court (ICC) from the analytical horizon of critical studies and the particular contributions of the Helsinki School and social idealism. To achieve this objective, the main postulates of both perspectives are compared towards the concept of international criminal justice (ICJ), in general, and towards the performance of the ICC in its time of validity, in particular. The methodology used is that of a documentary analysis with a strong inclination towards texts of a theoretical, doctrinal and jurisprudential nature.

More than 45 years of IEP/TP research and a few focused on IEP/TP functions or roles. Yet, the quality of an IEP/TP relies on the functions that it fulfills to satisfy the needs of its different users (Petitdemange,1985). The Quebec Ministry of Education (MEQ, 2004) and the Office of Special Education and Rehabilitative Services within the U.S. Department of Education (in Eichler, 1999) explicitly identified and described six to seven IEP/TP functions. However, a literature review and practising environments highlighted a greater number of functions. The goal of this research is to identify the different functions that an IEP/TP should fulfill in regard to the different needs of its diverse users. With the use of pedagogical value analysis method (PVA), results show a synthesis of more than 700 functions organized in an IEP/TP Functional Specification Matrix (FSM). The IEP /TP FSM is use...

This research aimed to compare the internalizing (anxiety and depression) and externalizing (hyperactivity) symptoms of Caraquenian children based on the level of food insecurity reported by their parents. A simple retrospective design was proposed with a sample of 200 children, aged between eight and twelve, and their representatives, in charge of reporting the food insecurity levels in their homes and the symptoms of perceived hyperactivity in their children. For the analysis of results, the non-parametric Mann-Whitney´s U technique was used to compare anxiety, depressive and hyperactive symptoms based on high and low levels of food insecurity. Results suggest moderate conditions of food insecurity in the households. Furthermore, regarding the set of internalizing symptoms evaluated, it was found that households with greater food insecurity tend to have children with greater manifesta...

The article describes the psychometric analysis of the APGAR Scale developed by Smilkstein (1978), consisting of five Likert items with five alternatives, which evaluates the perception of family functioning (Gómez & Ponce, 2010). The scale was administered to 256 male students aged from 11 to 18 attending state school in Lima. Item-test correlation analysis provided evidence of highly significant relations (p<0.001) for each of the reagents, indicating that reagents evaluate indicators of the same construct. To assess the perception of family functioning, APGAR Scale has moderate internal consistency (Cronbach a = .788). Construct validity was established by factor analysis and a single factor was obtained through a principal component analysis and the orthogonal rotation (Varimax).

The relationship between executive functions (EF), creative personality, and academic performance in Argentine university students was examined. A total of 248 students (M = 22.97 years, SD = 4.43) from various Argentine provinces participated. The Adult Executive Functioning Inventory (ADEXI), the Cognitive Flexibility Scale, the Creative Behavior Scale (ECC), and the Creative Personality Scale (EPC) were used, along with academic performance data and sociodemographic information. Data were collected online through Google Forms and analyzed using Spearman correlations and mediation analysis with robust Maximum Likelihood estimator and Bootstrap. Cognitive flexibility exhibited the most robust correlation with grade point average (r = .281, p < .001), followed by working memory difficulties (r = -.234, p < .001). Creative personality correlated positively with grade point average (...

Inside the mercantile system, the joint-stock company is relevant, evidenced by a historical analysis of this corporate form. This is worthy of a special legal regulation as contract type of company; currently reaching great diversification, influence and development under various corporate forms. The joint stock company thus becomes a legal figure that rests on the concept of «capital» which is his essence, term whose understanding is based on the distinction between «patrimony» and «social capital»; social capital that is governed by the principles of determination and unity of the Social Capital, and stability of Capital, those who complete the defence of the capital of the company by shares, with which it is intended to give adequate protection to the business.

In this study, we analyzed a three-dimensional nonlinear differential system considering Holling type II functional response that describes the dynamics of tumor cells, cytotoxic T lymphocytes, and helper T cells, with a single interaction delay. The linear stability of the internal equilibrium point and the presence of the Hopf bifurcation are examined, with the discrete time delay serving as the bifurcation parameter. To demonstrate the rich dynamic behavior of the model, we present numerical simulations with various values of the time delay τ and the attack rate of cytotoxic T lymphocytes on tumor cells (α1). These simulations exhibit the presence of periodic oscillations and tumor death with survival of the mentioned immune cells, for all α1 greater than a fixed threshold with or without delay.

In this research article, we will analyse the tradition «The First English Consul» by Ricardo Palma, based on the idea that, if Thomas Rowcroft had been able to speak correct Spanish or, in the second instance, had he had the help of a translator or interpreter, he could have escaped death, since his accessibility to the Spanish language would have prevented him from being seen as an easy prey by his assassins and would have facilitated better communication with those who could have saved his life. Behind this diplomatic case, in which a translator would have played a crucial role if he had been involved, lies the analysis of this text, which allows the recognition of an underlying and important theme: the role of the translator and interpreter in international relations, insofar as he or she must be a mediator between the representatives of two countries, whether they are friendly nat...

In this paper we analyze the factors that characterize the growth rates that reached the upper middle and lower middle income countries in 2009 by the statical technique multivariant the discriminant analysis, for which it was decided a priori to establish two groups based on positive and negative growth rates to apply this technique. Resulting the discriminant function, which show us the relevant factors for discrimination, these are: public spending, the rule of law, the fertility rate and the index of democracy.

This paper presents a comparative analysis of the electrode impedance for a vertical rod buried in a homogeneous ground where the soil electrical parameters (resistivity and permittivity) are frequency-dependent in relation to the impedances obtained with frequency-constant parameters. In this study, it is taken into account that vertical rod can be seen as a short transmission line whose electrical parameters (resistance, inductance, capacitance and conductance) are distributed along its length. Thus, the rod impedance is computed as being the harmonic impedance of the transmission line as a function of frequency. Once the rod impedances are obtained, and using the Vector Fitting technique, equivalent electrical circuits are obtained directly in time domain. The advantage of this type of representation is that equivalent circuit can be easily incorporated into EMTP-type programs for the...

This research seeks to address the question of why arbitral tribunals have interpreted treaties concluded by the United States as taking a pragmatic approach to the invocation of the denial of benefits clauses they contain. Thus, our hypothesis states that various of the arbitral tribunals that have interpreted these treaties adopting a pragmatic approach have interpreted these clauses following various methods of interpretation, among which (i) the literal method, (ii) the teleological method, and (iii) the functional method of interpretation are predominant. In this sense, the main objective of the research will be to identify the main grounds used by the arbitral tribunals when analyzing the moment of invocation of these clauses in this type of treaties. To this end, the methodology used is qualitative in nature and seeks to be mainly analytical of existing jurisprudence. The aim is t...
