This paper addresses the figure of the land tax focused on its social-economic transcendence. The author argues that this is an extra-fiscal resource of social order that can be used as an instrument of agrarian reform. In this sense, the use of this tax should not be considered as an addition to existing taxes, but as part of an organic tax system that does not discourage real estate investment. The author presents the historical development of the land tax, its characteristics and justification; he also distinguishes this figure from the estate tax and the capital tax. Finally, he analyzes the Peruvian draft laws that deal with the land tax and presents his conclusions based on the study carried out on this figure and the existing legislative projects.

This article is a systematization of the experience of an emblematic organization for family farmers in the Alto Paraná region of Misiones: Independent Producers of Piray (PIP), in the Union of Land Workers (UTT). The analysis has been carried out considering two articulated dimensions a) the collective organizational actions linked to the conditions of possibility, which in turn are permeated by conjunctural influences, and b) the trajectories and biographies of individual actors that account for the local history of the territory. This articulation has made it possible to analyze the political practices imbricated in the strategies of social reproduction. This systematization arises from the need to reconstruct a local history based on reflections within the framework of ethnographic involvement. The main contribution of the text lies in the identification of the reciprocities establi...

Dry forests are ecosystems of great importance worldwide, but in recent decades they have been affected by climate change and changes in land use. In this study, we evaluated land use and land cover changes (LULC) in dry forests in Peru between 2017 and 2021 using Sentinel-2 images, and cloud processing with Machine Learning (ML) models. The results reported a mapping with accuracies above 85% with an increase in bare soil, urban areas and open dry forest, and reduction in the area of crops and dense dry forest. Protected natural areas lost 2.47% of their conserved surface area and the areas with the greatest degree of land use impact are located in the center and north of the study area. The study provides information that can help in the management of dry forests in northern Peru.

The author analyzes the land tenure and size of the territory and the different perspectives of understanding the property, starting with the western angle of private property, with the individualistic nuance, through public ownership with its nuance of State resources, and finally by the idea of communal property with the collectivist hue, whose ownership lies not with the individual, or the state, but on a group previously identified as culturally consolidated.

In this article I present the new process of land concentration in Peru that has been taking place in the last fifteen years in the context of the laws generated inside the neoliberal model. These laws have allowed the emergency of the latifundium in the most fertile lands of the peruvian coast. Its production is mainly for export. Similarly mining concesions, oil and forestry are generating a new type of land concentration, degrading or destroying this resource together with the existing biodiversity. Finally, the prior consent of indigenous communities established in the Convention 169 ILO signed by the Peruvian state is not been respected as the land in their territories is being handed over as concessions.

In the latter half of the 20th century, Peru initiated agrarian reform efforts to restructure land tenures, notably exemplified by the subdivision of the Huando estate. This process encountered multifaceted legal and political challenges. This paper conducts a comprehensive examination of the legal intricacies stemming from the Huando estate's subdivisions, with a specific emphasis on administrative complexities. Additionally, it scrutinizes the rulings of the agrarian court pertaining to parceling, aiming to elucidate procedural and administrative dimensions. By delving into these aspects, the study seeks to discern the legal underpinnings shaping judicial determinations.

This article presents a case study that relates tourism development to the category of “land rent”. In particular, the target area has undergone a process of increasing real estate appreciation since 2003, when it was declared a heritage site by UNESCO. This phenomenon came to a halt a decade later, due to the exhaustion of the best land and the saturation of the hotel offer. Consequently, a new cycle began, marked by the expansion towards larger rural lands, but with the incentive of wine tourism and the new solar train. Thus, after the pandemic, a second stage of real estate expansion towards peri-urban areas was consolidated through the promotion of more exclusive leisure services, a situation that fed back into the differential appropriation of rents; specifically, “tourism monopoly rents”. In fact, data proving the described scenario are shown, based on the reconstruction of...

Despite the progress in the field of land use planning, it continues to be somewhat bureaucratic and sometimes far from social reality. The practice perspective shows that supralocal planning arises from the need to articulate business and local projects. Territory planning should not neglect this basic dimension attached to the reality of the “supralocal project”. You should also think about solving problems that arise in Municipalities and companies when they have a supralocal nature. In Spanish law there has been a progressive effectiveness of land use planning. A decisive step has been taken in recent years, betting on a model of strict regulatory binding (without prejudice to the nuances or levels or degrees of binding, full, basic, etc.) of the territorial planning instruments on urban plans. In this way, it is possible to grant practical virtuality to land use planning, openin...

This article examines the right to land ownership within the framework of the agrarian regime under the new Peruvian Constitution, focusing on integral agrarian development and the issue of smallholdings. Within this context, it is noted that although the Agrarian Regime prioritizes integral development, without effective agrarian reform, this could favor the wealthiest and perpetuate inequalities, as seen in Peru. In this sense, the author addresses the constitutional protection of property and criticizes the confusion between "right" and "guarantee" in the constitutional text, highlighting the possibility of other forms of private property not prohibited by law. Additionally, emphasis is placed on the social function of land ownership, which entails its use in harmony with social interests, and imposes obligations on the owner beyond neighborhood relations or public interest, such as t...
