También se analizan estudios previos nacionales e internacionales que refuerzan la viabilidad del divorcio incausado y su implementación en otros países, destacando los beneficios en términos de celeridad y menor impacto emocional.

The research proposes incorporating uncaused divorce into the Civil Code, allowing one of the spouses to dissolve the marriage without having to justify a cause. This would facilitate a faster and less conflictive legal solution, respecting the autonomy and well-being of those involved. The thesis includes a theoretical framework on the right to free development of personality and the theory of autonomy of will, arguing that both are fundamental rights that should support marital dissolution.
