This study explores the administrative discrepancies in the application of Article 7 of the 1929 Washington Convention on Trademark and Commercial Protection between Peru and Colombia. The article outlines the specific requirements for opposition, such as prior legal protection, continued use, and prior knowledge of the registered mark by the applicant. It also highlights significant case studies in both countries, providing a comparative analysis of administrative interpretations. The differences between Washington Convention-based opposition and bad-faith claims under the Andean Decision 486 are also addressed.
