Sin embargo, su implementación enfrenta desafíos críticos relacionados con la falta de directrices regulatorias claras, riesgos éticos, como la opacidad algorítmica y los sesgos, y una marcada desigualdad en el acceso a la tecnología. Este trabajo identifica estas problemáticas y propone soluciones mediante la creación de un marco regulatorio integral que fomente la innovación responsable y la equidad. Los principales instrumentos normativos analizados incluyen el Reglamento General de Protección de Datos (GDPR) y la Ley de Protección de Datos Personales peruana (Ley N° 29733), destacando sus limitaciones en la gestión de riesgos específicos de la IA. Además, se plantean estrategias como la implementación de un Portal Nacional de Transparencia Algorítmica, la introducción de sandboxes regulatorios para evaluar tecnologías en entornos controlados y programas de alfabetización digital para reducir la brecha tecnológica. Se concluye que la integración efectiva de la IA en la administración pública requiere garantizar la transparencia, la protección de derechos fundamentales y el acceso inclusivo. Asimismo, es imprescindible fomentar la participación ciudadana en el diseño de políticas, establecer mecanismos de supervisión independientes y promover la colaboración entre sectores público y privado. Estas medidas son esenciales para maximizar los beneficios de la IA mientras se mitigan sus riesgos éticos y sociales.

However, its implementation faces critical challenges related to the lack of clear regulatory guidelines, ethical risks such as algorithmic opacity and biases, and a marked inequality in access to technology. This paper identifies these issues and proposes solutions through the creation of a comprehensive regulatory framework that promotes responsible innovation and equity. The main regulatory instruments analyzed include the General Data Protection Regulation (GDPR) and Peru's Personal Data Protection Law (Law No. 29733), highlighting their limitations in managing specific AI-related risks. Additionally, strategies are proposed such as the implementation of a National Algorithmic Transparency Portal, the introduction of regulatory sandboxes to evaluate technologies in controlled environments, and digital literacy programs to reduce the technology gap. It is concluded that the effective integration of AI in public administration requires ensuring transparency, the protection of fundamental rights, and inclusive access. Furthermore, it is essential to encourage citizen participation in policy design, establish independent oversight mechanisms, and promote collaboration between the public and private sectors.
