Atendiendo a la práctica jurídica cotidiana de estipular cláusulas de no competencia poscontractual en los contratos laborales, este texto busca analizar la constitucionalidad de su incorporación y uso como medida limitativa de la libertad de trabajo. Para ello, a partir de una revisión histórica de la doctrina clásica del derecho del trabajo, se busca rescatar ciertos elementos de juicio que fueron propuestos en su momento para evaluar estas estipulaciones. Luego se postula la aplicación del test de proporcionalidad como herramienta que permita conciliar los intereses económicos del empleador con el derecho fundamental a la libertad de trabajo.

Traditionally, strikes in Peru have followed similar trends to economic cycles and have been led by workers' organizations in sectors such as mining and manufacturing. However, since 2017, public sector unions have begun to lead the three classic strike indicators: frequency, man-hours lost, and number of strikers. This research takes nationwide mobilizations as a case study and explains these changes in trends using the theoretical framework of the political opportunity structure. In particular, it argues that this rise in conflict originated in public administration due to the reform in the regulation of collective bargaining (openness or access to participation). At the same time, in the private sector, the variations are related to the support of the heads of administrative offices (availability of influential allies). Democratic opening scenarios provide favorable conditions for the development of workers’ organizations. However, these circumstances did not translate into sustained growth or recovery of pre-dictatorship indicators in Peru. The Peruvian literature tends to attribute it to the hyperdecentralization produced by the 1992 labor reform. This paper revisits this thesis to complement it and argues that the lack of adequate anti-union protection explains the lack of power of the organizations, particularly the consistent decline in collective bargaining coverage since 2006. For this purpose, we review the model and structure of collective bargaining from 1970 onwards, and the institutional framework in which unions operate. The research shows that the scope of collective bargaining agreements— during the first decade of the twenty-first century—exceeded union membership, indicating ...

Esta tesis persigue articular el estándar constitucional y convencional de protección contra el despido, y responder a la pregunta sobre cómo se aplica en nuestra legislación laboral. La hipótesis planteada plantea que el contenido de los estándares en cuestión resultan aplicables, pues existen espacios de disonancia con el marco normativo vigente. A partir de ello, se establece como objetivo principal desarrollar el contenido de los mandatos constitucionales y convencionales relativos a la materia, así como su aplicación al ámbito subjetivo de la protección contra el despido.
