En el presente artículo, el autor analiza el impacto del COVID-19 en la actuación de la Administración Pública en la gestión de los recursos hídricos en Perú, a partir de siete (07) áreas: la gobernanza del agua e impacto de los Objetivos de Desarrollo Sostenible 3 y 6; el otorgamiento de derechos de uso de agua y otros procedimientos administrativos relativos a su ejercicio; la continuidad de las labores de los servidores públicos de la Autoridad Nacional del Agua; el rol de las organizaciones de usuarios de agua; la fiscalización y sanción en materia de aguas; la relación entre la gestión de recursos hídricos, actividades estratégicas y servicios esenciales para el manejo de la crisis; y las buenas prácticas y desafíos en la gestión de recursos hídricos en el país.

En el presente artículo, el autor analiza la manera en la que las organizaciones de usuarios de agua contribuyen al aprovechamiento sostenible de las aguas subterráneas en el Perú. Para ello, comienza describiendo los instrumentos normativos provistos en el país para la gestión del recurso hídrico en mención y el régimen aplicable para su aprovechamiento por parte de los usuarios de agua, a partir de los cuales se conforman las organizaciones de usuarios de agua; seguido por la presentación de la figura de dichas organizaciones como actores que coadyuvan a la sostenibilidad de las aguas subterráneas y; finaliza con un breve análisis sobre la sostenibilidad de las aguas subterráneas a partir del aprovechamiento por parte de las organizaciones de usuarios de agua.

El presente estudio brinda una aproximación jurídica al concepto de pobreza energética y sus principales características para ser atendida adecuadamente desde el Derecho Público Económico. El enfoque multidimensional de la pobreza energética se aterriza en el ordenamiento peruano a partir de la experiencia normativa y de políticas públicas emprendidas por este país en los sectores de electricidad y gas natural. El estudio advierte destacados avances en la reducción de la brecha de pobreza energética, pero también algunos retos que aún quedan por ser atendidos para la reducción efectiva de la misma.

El presente trabajo tiene por objeto revisar la figura jurídica de la servidumbre administrativa apropósito de la Industria de Electricidad en el Perú. En ese sentido, se ha considerado necesario el estudio del sistema de limitación de la propiedad privada, haciendo un especial énfasis en la noción de propiedad, expropiación forzosa y servidumbre administrativa. Se precisa, asimismo, respecto al funcionamiento de la servidumbre administrativa en la Industria de Electricidad.

By means of this article, the author explains the legal nature of the audit reports or inspection reports, detailing their evidentiary value and the manifestation of the principles of due process, material truth and legitimate exercise of power. To this end, the author starts by developing the nature of the audit activity in the Peruvian legal system and its link with the sanctioning power of the public administration, taking into account the provisions of Chapter II of Title IV on the audit activity in the General Administrative Procedure Law.

In this article, the author analyzes how water user organizations contribute to the sustainable use of groundwater in Peru. In order to do that, he begins by describing the regulatory instruments provided in the country for water resource management and the applicable regime for its use by water users, from which water users’ organizations are formed; after that, he presents the figure of these organizations as actors who contribute to the sustainability of groundwater and; finally, he makes a brief analysis of the sustainability of groundwater from the use by water users’ organizations.

This study provides a legal approach to the concept of energy poverty and its main characteristics to be adequately addressed by the economic administrative law. The multidimensional approach to energy poverty is established in the Peruvian legal system based on the normative experience and public policies undertaken by this country in the electricity and natural gas sectors. The study notes notable progress in reducing the energy poverty gap, but also some challenges that still need to be addressed in order to effectively reduce it.

In this article, the authors seek to make administrative law visible as a tool for university social responsibility. For this purpose, a qualitative methodology is used, which involves the review of norms and specialized doctrine that allows, on the one hand, the identification of the actors responsible for the fulfillment of public purposes and/or interests such as the State and the university; and, on the other hand, the development of the university social responsibility approach in Peru and the systematization of activities carried out in the framework of the implementation of the university social responsibility initiative promoted by the Pontificia Universidad Católica del Peru, in collaboration with the Municipality of Miraflores in Lima, Peru.

Las Octavas Jornadas de Derecho de Aguas se realizaron el 11 de diciembre de 2020 gracias a la iniciativa del Centro de Investigación, Capacitación y Asesoría Jurídica (CICAJ) de la Pontificia Universidad Católica del Perú (PUCP) y el Grupo de Investigación en Derecho Administrativo de la PUCP (GIDA). En esta edición de las Jornadas, expertos nacionales e internacionales reflexionaron sobre los retos que implica la pandemia por el COVID-19 para Perú, Brasil, Chile, Colombia y España. Este volumen compila artículos arbitrados organizados en dos secciones: «La gestión de recursos hídricos en el contexto del COVID-19» y «Los servicios públicos de agua potable y saneamiento en el contexto del COVID-19». Esperamos que este libro contribuya al debate académico sobre el rol del Derecho de aguas frente a los retos que supone la pandemia por el COVID-19.
