The importance of providing equal treatment to citizens, and of the predictability of public administration in resolving their disputes or requests is undeniable. In this context, the administrative precedent is an important tool to achieve the aforementioned objectives, allowing the performance of Public Administrations to provide legal certainty and avoid arbitrary situations.

Las Octavas Jornadas de Derecho de Aguas se realizaron el 11 de diciembre de 2020 gracias a la iniciativa del Centro de Investigación, Capacitación y Asesoría Jurídica (CICAJ) de la Pontificia Universidad Católica del Perú (PUCP) y el Grupo de Investigación en Derecho Administrativo de la PUCP (GIDA). En esta edición de las Jornadas, expertos nacionales e internacionales reflexionaron sobre los retos que implica la pandemia por el COVID-19 para Perú, Brasil, Chile, Colombia y España. Este volumen compila artículos arbitrados organizados en dos secciones: «La gestión de recursos hídricos en el contexto del COVID-19» y «Los servicios públicos de agua potable y saneamiento en el contexto del COVID-19». Esperamos que este libro contribuya al debate académico sobre el rol del Derecho de aguas frente a los retos que supone la pandemia por el COVID-19.

El presente trabajo analiza los principales desafíos que enfrenta el sector saneamiento en el Perú centrando la atención en el sinceramiento de las tarifas que se debe dar para lograr que las recientes reformas normativas tengan éxito. En tal sentido, el objetivo principal de este estudio es demostrar que, como ha sucedido con otros servicios públicos domiciliarios (telecomunicaciones, electricidad y gas natural) en el caso del agua potable y alcantarillado (saneamiento) resulta necesario que el organismo regulador (SUNASS), en cumplimiento de la función reguladora. establezca las tarifas que permitan que la prestación del servicio de saneamiento resulte eficiente y sostenible en el tiempo.

En el presente trabajo el autor realizará análisis breve respecto del cambio de terminología del concepto de servicios Públicos a raíz de los procesos de liberalización que se plantearon en la Unión europea, centrando los intereses en el servicio universal, dándole un mayor desarrollo al tema respecto del caso del sector eléctrico. Luego de ello, examinará el proceso de liberalización del sector eléctrico peruano e intentará responder la interrogante si, resulta posible, en nuestro país hablar de servicio Universal en el sector eléctrico.

This article addresses the principle of subsidiarity in the context of a social market economy. This is related to how the principle of subsidiarity has been interpreted and applied in our legal system. Since the change in the 1990s in the role of the State from provider to guarantor, and the incorporation of the principle of subsidiarity, its scope and limits have been questioned. The Peruvian Consumer Protection Authority—Indecopi, has been the one solving cases of possible violations of the principle of subsidiarity, and in this context has issued a "precedent of mandatory observance", which is extremely important to analyze so as to provide context to article 60 of the Peruvian Constitution.

In this article, the authors seek to make administrative law visible as a tool for university social responsibility. For this purpose, a qualitative methodology is used, which involves the review of norms and specialized doctrine that allows, on the one hand, the identification of the actors responsible for the fulfillment of public purposes and/or interests such as the State and the university; and, on the other hand, the development of the university social responsibility approach in Peru and the systematization of activities carried out in the framework of the implementation of the university social responsibility initiative promoted by the Pontificia Universidad Católica del Peru, in collaboration with the Municipality of Miraflores in Lima, Peru.
