En el Perú, durante la última década, se realizó un cambio en la legislación en materia de recursos hídricos, generando entre sus innovaciones la creación de la Autoridad Nacional del Agua (ANA) y, como parte de este organismo público, un tribunal de resolución de controversias y conflictos como última instancia administrativa. En ese sentido, el Tribunal Nacional de Resolución de Controversias Hídricas de la Autoridad Nacional del Agua (en adelante ana) del Perú fue instalado2 hace un año y asumió competencia sobre las funciones establecidas en la Ley de Recursos Hídricos.3 Este artículo presenta su naturaleza jurídica, sus características, sus funciones, así como una breve evaluación de las principales materias de los conflictos que ha conocido este órgano colegiado en esteprimer año de funcionamiento.

¿Cómo afecta la pandemia del COVID-19 a las ciudades? ¿Cuál es el impacto de las medidas adoptadas para combatir dicha enfermedad respecto del derecho urbanístico? ¿Cuáles son los principales retos impuestos por dicha enfermedad a esta rama del derecho administrativo? El presente artículo busca dar respuesta a estas interrogantes a partir de la definición de derecho urbanístico y los principales ejes que conforman su contenido. Asimismo, se analiza el impacto de las nuevas políticas de distanciamiento social dentro de los espacios públicos, así como en el servicio de transporte. Por último, se esbozan unas breves reflexiones sobre la importancia de la vivienda como espacio para la convivencia y continuidad de actividades de los ciudadanos en este contexto actual.

Although urban legislation is fundamental to improve the living conditions of Peruvian cities, in the case of Metropolitan Lima the regulatory framework for urban planning is, to say the least, chaotic and ineffective. For this reason, in this paper we describe and analyze the regulatory framework of urban development at the metropolitan level with the objective that the legibility of the regulations helps to improve the design of public policies and guidelines for the planning of the city. Through cabinet analysis, workshops and unstructured interviews, we studied the history, actors and instruments of the urban planning regulatory framework of Metropolitan Lima. We conclude that this legal framework currently faces critical challenges such as administrative fragmentation and lack of vision of the city, institutional weakness and the lack of systematicity in the regulations.

This article offers a brief historical and regulatory review of environmental management and environmental law in Peru, presenting some reflections on the challenges and issues of sustainable development. It also introduces the articles published in issue No. 15 of the Revista Kawsaypacha: Sociedad y Medio Ambiente (Kawsaypacha Journal: Society and Environment), which has been divided into three sections featuring highly interesting contributions and research.

COVID-19 Pandemic has created different challenges for Peruvian cities. How Urban Law and urban regulation should respond to those challenges? The article tries to respond to this question by revisiting the concept of Urban Law and the principles that are behind it. Moreover, the article will explore the impacts that the social distancing policies have had in territorial planning, public transport and public spaces and how this new context requires a reframe in the policies that regulate those sectors. The final section is dedicated to highlighting the importance of housing in the social distancing context and how the housing regulation should evolve to create a real safe-place from the risks imposed by the COVID-19 that allows the continuity of life in this new reality.

Faced with the urgent call to action raised in the latest IPCC report, this paper takes a panoramic review at the general problems of Peruvian cities tackling climate change, revealing that the challenge is twofold: to build resilience to climatic variability, but above all to overcome the structural causes that produce high levels of social and ecological vulnerability. It is concluded that the four dimensions of environmental justice -distribution, recognition, participation, capacities- allow a more complete analysis of the vulnerabilities to overcome and achieve fair resilience; also, progresses have been found in this regard.

Si bien la legislación urbana es un pilar fundamental para mejorar las condiciones de habitabilidad de las ciudades peruanas, en el caso de Lima Metropolitana el marco normativo de la planificación es, por decir lo menos, caótico e ineficaz. Is the Right to Adequate Housing recognized in the Peruvian Political Constitution of 1993? What has the Constitutional Court ruled regarding this Right? How may the Public Law help to overcome the challenges imposed by the need to guarantee the Right to Adequate Housing? This article tries to answer these questions by analyzing the regulation of the Right to Adequate Housing in international treaties and instruments applicable to our country, and the national regulation and jurisprudence. The last section will reflect on the challenges to the Right to Adequate Housing under the framework created by the National Housing and Urban Policy (2021) and the Act 31313, Sustainable Urban Development Act.

En este contexto de urbanización generalizada y de globalización, la relación entre los centros urbanos y los ciudadanos es compleja e interdependiente, con múltiples y variados problemas urbanos.
