The article develops the regulation of the food market service in Peruvian legislation, after the new regulatory changes that occurred before and during the COVID-19 pandemic. In addition, the existing typologies on markets, the public actors involved and the administrative legal regime that adheres to the Peruvian legal system are studied. Finally, two aspects that food markets maintain in regard to the new legislation related to urban development and food safety are analyzed. Likewise, after a legal analysis of the regulations, administrative doctrine, and jurisprudence we found an underway process to recover the role that the public administration has in the promotion, construction and operation of the food markets, after the processes of liberalization and privatization that occurred in Peru during the nineties.

The objective of this article is to analyze the role of urban planning and building parameters in guaranteeing the right to adequate housing in Metropolitan Lima, with emphasis on social housing (SIV). To this end, we develop a state of the art on the urban regulation of SIV until December 2022, which shows that there is no consensus among the different levels of government regarding the mechanisms to promote the production of SIV and guarantee the right to housing. El caso trata de la interposición de un Recurso de Agravio Constitucional contra la Resolución N° 2 de fecha 28 de enero del 2008 de la Tercera Sala Civil de la Corte Superior de Justicia de Lima interpuesto por Shougang Hierro Perú. Dicha resolución se declaró la improcedencia liminar de la demanda de amparo contra la Ordenanza Municipal N° 006-2007-A/MPN que vulneraba según el demandante sus derechos a la libertad de empresa e industria, así como el derecho a la propiedad, al trabajo, al debido proceso y a la defensa. En un primer momento el 45° Juzgado Civil de la Corte Superior de Justicia de Lima declaró improcedente la demanda. Although urban legislation is fundamental to improve the living conditions of Peruvian cities, in the case of Metropolitan Lima the regulatory framework for urban planning is, to say the least, chaotic and ineffective. For this reason, in this paper we describe and analyze the regulatory framework of urban development at the metropolitan level with the objective that the legibility of the regulations helps to improve the design of public policies and guidelines for the planning of the city. Through cabinet analysis, workshops and unstructured interviews, we studied the history, actors and instruments of the urban planning regulatory framework of Metropolitan Lima. We conclude that this legal framework currently faces critical challenges such as administrative fragmentation and lack of vision of the city, institutional weakness and the lack of systematicity in the regulations.

Si bien la legislación urbana es un pilar fundamental para mejorar las condiciones de habitabilidad de las ciudades peruanas, en el caso de Lima Metropolitana el marco normativo de la planificación es, por decir lo menos, caótico e ineficaz. Por ello, el objetivo de este texto es describir y analizar el marco normativo del desarrollo urbano a nivel metropolitano con miras a que la legibilidad de las normas ayude a mejorar la formulación de políticas públicas y lineamientos para la planificación de la ciudad. For that purpose, it considers the growing recognition of the importance of cities under the ‘New Urban Agenda’ and the search for assurance of decent life quality for the inhabitants of a city. Moreover, the authors propose to overcome the conception of the city as a physical space where its sole purpose is to produce individual wealth and benefits, for its recognition as a space of interaction and citizen development as a collectivity. Based on this definition, the right to the city implies a guiding principle that seeks to generate spaces for community participation, a fair distribution of urban charges and benefits, and the promotion of active citizenship.
