The article 48 from the called “Texto Único Ordenado” of the Contentious-Administrative Process Law establishes as a cause of nullity of acts and regulations its contradiction with judgments, in order to avoid its compliance. All the elements and requirements, so that this cause of nullity might happen, are analyzed in the paper. And it is argued that such cause of nullity can be successfully alleged in the process of enforcement of judgments and in autonomous processes.

The present work deals with the omission of pronouncement by the administration in relation to the arguments and evidence presented by the administered, a situation that has not deserved further development in the doctrine addressed in it, but that has been considered as a cause of nullity of the administrative act in certain judicial decisions, given that the principle of due administrative procedure is violated and the motivation requirement is breached and, therefore, the right of defense of the company is strongly affected. In this line, it is convenient to deepen and disseminate this omission as grounds for nullity of the administrative act.

Article 220 of the Civil Code allows the judge to declare ex officio the nullity of a legal act, but only if it is ‘manifest’. This capacity of the judge has generated two important questions: what steps must the judge follow to declare the nullity ex officio; and how can a manifest nullity be distinguished from a non-manifest nullity?In this line, the author of this paper addresses the first question by making an extensive analysis of what is set forth in different case law (files of the Tribunal and Plenary Cassations). One of the main objectives of any legal system is legal certainty, which is understood as the provision of decisions in the work of the courts. To this end, in order to standardize the diversity of decisions of courts for the same conflict, there are meetings of supreme judges who seek to give a unique sense of resolution to the same conflict. The article begins by recognizing that the Administrative Process in Peru is full jurisdiction, protects the legal situations in addition to control the legality of the administrative acts. The purpose of this paper is to clarify, based on the nature of the nullity processes in administrative appeals, the apparent conflict that arises when interpreting the effects of the new evidence in reconsideration appeals. To do so, two key issues are addressed: the object of administrative appeals and the evidentiary activity in administrative proceedings. The analysis of these issues allows us to reach an adequate and systematic interpretation that defines the scope of the new evidence.

El presente trabajo realiza precisiones respecto al proceso de desalojo por ocupación precaria para analizar la figura de la nulidad y nulidad manifiesta de oficio, a la luz de los criterios establecidos en el IV y XI Pleno Casatorio Civil. En los presentes informes se expondrán las principales piezas procesales tanto del expediente privado como público. Respecto al expediente privado, se discute la materia de desalojo por ocupación precario, si efectivamente a la demandante le corresponde la restitución del inmueble, materia litis. Puesto que existen otros procesos de prescripción adquisitiva de dominio y nulidad de acto jurídico. Por otro lado, en el expediente público se discute si hay o no infracción por idoneidad al Código de defensa y protección al Consumidor, puesto que se incumplió con la entrega del inmueble en el plazo pactado debido a que la demora fue por culpa no imputable a la parte denunciada.

The due motivation for issuing decisions is the constitutional right of citizens to know the factual and legal reasons that the authorities and officials, especially those of the State apparatus, adopt to resolve claims, where their interests are included. This right is a component of the due process, also called fair process, an expression of effective procedural protection.
