This paper explores the idea of community through the proposals of some contemporary thinkers who have tried to rethink the concept of being in common assuming some of its paradoxes. For authors like Roberto Esposito, Jean-Luc Nancy and Giorgio Agamben, thinking “the community” implies reflecting on it from the paradoxes and contradictions it contains, both conceptually and in terms of everyday reality. The central paradox that sums such contradictions is stating that the community is feasible only to the extent that it is not. Close to Russell’s paradox, such aporia allows us to recognize the difference between the community that takes care of its contradictions and inconsistencies, the community of the crisis, and the one that, conceived in absolute and unequivocal terms, is not responsible for their antinomies and contradictions, and leads to what we call the community crisis.

Since 2006 the indigenous political vote has split between Pachakutik and Alianza País (AP). The latter is a political movement led by Rafael Correa, currently president of Ecuador. The article seeks an explanation for this distribution of the vote, examining the political behavior of the indigenous people of the Otavalo and Cotacachico unties of the northern Ecuadorean highlands. It argues that the support for Correa can be explained by several factors: (1) the historical relationship between indigenous people and the State; (2) an electoral behaviour that combines trust in ethnic leaders and pragmatism; and (3) an expectation of «more state presence». The study is based on two surveys of leaders and local population, participant observation and interviews, as well as a document review.

Purpose – The aim of this paper is to examine the role of liquidity in asset pricing in a tiny market, such as the Portuguese. The unique setting of the Lisbon Stock Exchange with regards to changes in classification from an emerging to a developed stock market, allows an original answer to whether changes in the development of the market affect the role of liquidity in asset pricing. Design/methodology/approach – The authors propose and compare two alternative implications of liquidity in asset pricing: as a desirable characteristic of stocks and as a source of systematic risk. In contrast to prior research for major stock markets, they use the proportion of zero returns which is an appropriated measure of liquidity in tiny markets and propose the separated effects of illiquidity in a capital asset pricing model framework over the whole sample period as well as in two sub-samples, d...

This work is intended to describe an important part of the regulatory problems on common land in Peru. To this end, we hypothesize that there are various issues that the regulatory framework and procedures in force do not allow to guarantee the rights of peasant communities and the proper use of their lands. To confirm our hypothesis, we will analyze the following issues related to the regulation of common land: i) relationship with natural resources, ii) lack of demarcation and titling, iii) overlapping of rights, iv) update of registers, statutes and boards of directors, v) high number of members that complicates to make agreements, vi) usufruct rights and individual adjudication within the community. To develop some of the problems identified we have reviewed real cases which will be used as examples to represent the situation of the system.

The present study aims to explore the essential foundations of both liberalism and republicanism, starting from individual freedom and the common good, respectively, and focusing on the fundamental concept of liberty. To achieve this, the concepts of private property, non-interventionism, and state neutrality in liberalism, and community, social purpose, and the public sphere in republicanism, derived from the aforementioned terms, will be analyzed. The objective of this research is to evaluate the practical feasibility of both ideological currents and consider the possibility of a synthesis between them. Hence, the guiding question will be: which of the two is more feasible in practical life, or if there can be a synthesis between them? In response to this question, it is argued that liberalism is the most feasible and viable stance, as republicanism is contradictory in its principles a...

One of the most important issues in Andean Community administrative law concerns the extension of the locus standi to request preliminary rulings from the Court of Justice of the Andean Community (TJCA). In fact, the TJCA has interpreted the concept of “national judge” in a broad and generous manner, including the administrative bodies of the Member States, as well as arbitrators. Thus, the research problem revolves around what is understood by “national judge” in the light of Andean Community Law and the object and purpose of the mechanism of preliminary rulings. The main hypothesis is that administrative bodies and arbitrators are, in fact, “community judges” because they collaborate in the interpretation and uniform application of community law. In this sense, this paper will analyze the preliminary ruling interpretation as one of the most important vehicles to guarantee t...
