description RESUMEN En el mundo, existen dos principales sistemas de transferencia de propiedad: por un lado se tiene al sistema español o romano que acoge la teoría del Título y modo, y por el otro lado el sistema Francés, consensual o espiritualista. En nuestro País contamos con un sistema mixto, acogiendo ambos sistemas, el español o romano para bienes muebles y el sistema Francés para bienes inmuebles. Al respecto, en los últimos años han surgido distintas posiciones acerca de la eficiencia de la adecuación de ese sistema en la realidad en dónde sólo es necesaria la simple voluntad para transferir un bien inmueble, En la presente investigación se busca determinar el motivo del acogimiento de este sistema, y si en la actualidad es beneficiosa su adopción, así como también de la contradicción del artículo 949° que regula la compraventa de bienes inmuebles con el artículo 1135° del Código Civil, que regula la figura de concurrencia de acreedores de bienes inmuebles y en cómo esto afectaría a la tan ansiada Seguridad Jurídica de los contratantes y a la Sociedad actual.
