La presente investigación denominada “Responsabilidad ambiental por derrames de petróleo y la fiscalización ambiental en el sistema jurídico peruano”, tiene como finalidad determinar si existe una infracción a las reglas de naturaleza ambiental que se trae como consecuencia de los derrames de petróleo suscitados en el Perú por mucho tiempo. Se suscitaron derrames en la Amazonía Peruana. Por lo tanto, tiene enfoque cualitativo y un método inductivo. Es necesario comprender y entender sobre la naturaleza especial de este fenómeno, ya que involucra diversos aspectos relevantes no solo hacia la población en general, sino también, dentro de la normativa ambiental en relación a los agravios ambientales, y las que correspondan conforme a la naturaleza del daño, que, en la actual investigación y se trata de los derrames de petróleo. En base a este tema, existen varios cuestionamientos adoptados por diferentes instituciones, ya que las normas en materia ambiental relacionadas a la contaminación ambiental por derrames de petróleo no son suficientes para regular este hecho, que, con el paso del tiempo, genera perjuicios a la población, flora, fauna y al espacio en el que estos se desenvuelven. |

Spills occurred in the Peruvian Amazon. Therefore, it has a qualitative approach and an inductive method. It is necessary to comprehend and understand the special nature of this phenomenon, since this involves many aspects relevant not only for the population in general, but also within the environmental damage regulations, and where appropriate according to the origin of the damage, which in the present investigation, are oil spills.
