description En el expediente N° 2306-2012/CPC, materia del presente informe jurídico, se inicia el procedimiento administrativo que versa sobre protección al consumidor producto de la denuncia que formuló el segundo adquirente de un automóvil respecto al servicio técnico que brindó la empresa que vendió dicho vehículo. Los cuestionamientos planteados en la denuncia fueron calificados como presuntas infracciones a los artículos 18° y 19° de la Ley 29571, en adelante Código de Protección y Defensa del Consumidor donde se encuentra regulado el deber de idoneidad. Al evaluarse los medios probatorios, en primera instancia, se concluye que ellos no acreditaron que el denunciado haya brindado un servicio no idóneo. Dicha decisión fue revocada por la Sala Especializada en Protección al Consumidor en segunda instancia. En sus descargos, el denunciado señaló que la denuncia tuvo que haber sido declarada improcedente, ya que había prescrito la potestad sancionadora de la Comisión. Además de que el denunciante no calificaba como consumidor al no haber sido quien inicialmente compró el automóvil. Ambos fundamentos fueron desestimados en ambas instancias.

Ambos fundamentos fueron desestimados en ambas instancias.In file No. 2306-2012/CPC, subject of this legal report, an administrative procedure for consumer protection took place prompted by the complaint made by the second purchaser of a car regarding the technical service provided by the company that sold the vehicle. The questions raised in the complaint were classified as alleged violations of the duty of suitability, as regulated by articles 18 and 19 of Law No. 29571, hereinafter the Consumer Protection and Defense Code. When evaluating the evidence, in the first instance, it is concluded that they did not prove that the accused has provided an unsuitable service. Said decision was revoked by the Specialized Chamber for Consumer Protection in second instance. The defendant indicated that the complaint should have been declared inadmissible, since the sanctioning power of the Commission had expired. In addition to the fact that the complainant did not qualify as a consumer since he was not the one who initially bought the car.
