description La presente tesis titulada “La obligatoriedad de la vacunación como medida antipandémica y la libertad a decidir”, busca determinar cuál es la incidencia que tiene una medida de vacunación obligatoria en la libertad a decidir. La idea del presente trabajo de investigación tiene su origen en la pandemia que atravesara el país (y el resto del mundo) por la enfermedad causada por el virus del Covid-19, y las controversias que se suscitaron a partir de la necesidad de que una gran parte de la población se vacunara. El autor plantea la idea de que una medida de vacunación obligatoria – que tiene como objetivo contrarrestar los efectos de una pandemia – si bien es cierto limita la libertad a decidir, dicha limitación no es inconstitucional. En ese sentido, se estudió conceptualmente la libertad a decidir y los otros derechos involucrados en el desarrollo de una pandemia, realizando finalmente un test de proporcionalidad que dilucidara la constitucionalidad de la medida antes mencionada. De esta forma, se llegó a la conclusión de que la incidencia limitativa no es inconstitucional, pues las circunstancias de una pandemia justifican la aplicación de la vacunación obligatoria con el objetivo de salvaguardar derechos como la salud y la vida.

The idea for this research arises from the pandemic that affected the country (and the rest of the world) due to the disease caused by the Covid-19 virus, and the controversies that emerged from the need for a large portion of the population to be vaccinated. The author proposes that although a mandatory vaccination policy — aimed at countering the effects of a pandemic — does indeed limit the freedom to choose, such a limitation is not unconstitutional. In this regard, the study conceptually explores the freedom to choose and other rights involved during the development of a pandemic, ultimately applying a proportionality test to determine the constitutionality of the aforementioned measure.
