description La presente investigación ha considerado por objetivo general determinar los presupuestos jurídicos para acreditar la violencia psicológica en mujeres; empleando un tipo básico de investigación, de nivel descriptivo, en una población formada por un fiscal, un abogado, dos jueces así como el análisis de tres jurisprudencias; entre los hallazgos se obtuvo que uno de los efectos jurídicos sobre no contar con presupuestos jurídicos establecidos es la revictimización, provocando el archivamiento de casos; la forma común de acreditación de la violencia psicológica son las pericias psicológicas; los principios jurídicos vulnerados son el Principio de Igualdad y No Discriminación, Principio de intervención inmediata y oportuna, Principio de sencillez y oralidad, además se vulnera el derecho a la integridad psíquica prevista en el Art. 2° Numeral 1 de la Constitución Política del Perú; se concluyó que los presupuestos jurídicos que acreditan la violencia psicológica en mujeres, se basan en comportamientos que tienden a someter la dignidad de las mujeres a niveles que justifican la intervención del Derecho Penal; sustentados en informes periciales, análisis de la condición de la víctima, medios probatorios racionales, conductas típicas que originan lesiones psíquicas, cognitivas o conductuales, existencia de dolo.
