description El control constitucional en el ámbito arbitral representa un tema de creciente relevancia en el contexto jurídico contemporáneo, por ende, se hace imperativo comprender los fundamentos, alcances y desafíos que conlleva el control constitucional en el ámbito arbitral, por ende, la investigación conlleva como objetivo: registrar las razones de la necesidad de fiscalizar el control constitucional en sede arbitral. Asimismo, para responder el objetivo se analizó 5 laudos arbitrales y se entrevistó a 10 árbitros, se recoge la importancia de interpretar las normas legales a la luz de la Constitución y aplicar el control difuso cuando sea necesario para garantizar el debido proceso arbitral. Esto se evidencia en el Decreto de Urgencia N°020-2020 favorece de manera desproporcionada e injustificada al Estado en el trámite de pedidos cautelares en arbitrajes, lo que contraviene el principio de igualdad ante la ley consagrado en la Constitución peruana.
